My brother works as a Sheriff in Port St. Lucie area. I bought him a stripped Anvil Arms lower as a surprise gift. Can I mail it to his wife. He is of age and can legally own a weapon in the State of Fla. I once mailed a M1a USPS to a FFL with no problem out of state. So I know it can be mailed using USPS.

You can ship a firearm in state to another individual. Once it crosses state lines is when you have to send it to an FFL.

I've done a few deals in the EE here in Florida where I've shipped the complete gun or lower to a person.

Yep, you can ship it directly to anyone in state. The only iffy area is if you don't know the person... but since it's your bro's wife and you know for sure he isn't a felon or a wife beater, you're good to go. Oh and yes you can ship rifles via USPS.. just save yourself some grief and don't tell them what it is unless they ask

The only problem with not telling them what it is, or going with "Machine Parts" (Another common suggestion) is that if you fail to declare the contents you can't get insurance on the package. If you lie, any insurance is null and void.

I'd personally suggest UPS. But not one of the UPS stores. Like one of their corporate hub-thingies. But that's just me.

Well, USPS only asks you if it's "fragile, liquid, perishable, or potentially hazardous".. that's about it. You can insure it for anything you want after that. Just don't walk up and say "no it's not fragile, liquid, perishable, or potentially hazardous, its a rifle" I think UPS and FedEx are they ones who specifically asks "What's in the box sir".

ETA; I would avoid UPS hubs at all costs.. they won't let you ship anything unless you're an FFL or its going to an FFL for repair only. I shipped a rifle once, the story is in the archives somewhere but it was a mess. I first tried UPS and they flat out refused unless I was an FFL holder, everything would have been gravy if I just told them that it was going to an FFL for repair, but I had told them that I was sending the rifle to an FFL for sale. I finally got it sent via USPS after sitting down with them for like 45 minutes going over the rule book, unpacking and packing the rifle in store and then having the double check the rifle for > 16"... AFTER they took 20 minutes to figure out that over 16 is good and under 16" is bad.

I have said this SOOOO MANY times on this forum -- and you guys don't listen ....


Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm. [18 U. S. C. 922( a)( 2)( A) and 922( e), 27 CFR 178.31]


IT IS ILLEGAL to not notify the carrier it is a firearm ......

It is also ILLEGAL to mark the box indicating it contains a firearm.

But to answer the OP ...

Yes you can ship a rifle in state to whomever you want and since its a rifle you can ship it either USPS (any method) or UPS (Pistols can only go UPS Next Day Air, there is no listed shipping method requirement for rifles).  FedEx wont take it unless you have a FFL.  YOU DO NEED to notify the carrier it is a firearm.  You also need to take the rifle directly to the post office or a UPS main hub.  

ALSO -- Where it is illegal to NOT notify the shipper its a weapon, the law does not specify what method you need to ship the item.  This is a UPS rule and not LAW.  Little known to most -- UPS also states:


UPS does not accept automatic weapons, including machine guns, for shipment.


Leaving an M16 owner no method available to ship his rifle anywhere, period.  Then again the law does not require you to specify to UPS its a machine gun versus a rifle
