ok I am not sure on the edicate here as in starting a new thread vs hijacking this one. So here we go. heraldtribune.com/article/20070906/NEWS/709060436 Police say man took out gun in restaurant By LATISHA R. GRAY [email protected] SARASOTA -- Police arrested a 75-year-old man Tuesday on charges he pulled out and cocked a loaded semiautomatic pistol at Patrick's restaurant on Main Street. Several witness said they were frightened when Albert H. Rudolph III pulled the .45-caliber gun from underneath his shirt, cocked it and put it on a plastic tray his bill came on, a police report stated. Patrick's employees said later that day that they found a bullet under Rudolph's table. Rudolph, of the 3400 block of Brookline Drive, told police he took out the gun because he was trying to get money out of his pocket to pay for lunch. Officers said Rudolph had four alcoholic drinks with his lunch. "There is nothing good about people carrying firearms and consuming alcohol at the same time," said Sarasota Police Capt. Stan Duncan. "Usually, something bad results from that." Rudolph has a concealed weapons permit, but it is illegal to carry a gun at a place that serves alcohol, Duncan said. Rudolph paid his bill and was stopped by officers outside the restaurant. They found two full clips in a holster near Rudolph's back pocket, the report says. Rudolph was arrested and charged with improper exhibition of a firearm and possession of a firearm in a location where alcohol is sold, both misdemeanors. He was released from the Sarasota County jail Tuesday night, with bail set at $620. So I can not pack in place that sells alcohol or serves alcohol?? I know no bars. Schools, courts, airports, sporting events what else? |
Well my understanding of state law was it was unlawful to carry in a place that primarily serves alcohol. like a bar, or like the bar inside of an applebees. Whereas you could carry in the restaurant portion and still be legal. However the article isnt exactly clear on that and already shows inaccuracy by calling a magazine a clip. So how much do you trust the article and will the charges even stick? This guy really screwed up by taking out his firearm in public and by consuming alcohol while carrying(as a matter of principle not necessarily law).
I also suggest reading the rest of chapter 790. www.flsenate.gov/Statutes/index.cfm?App_mode=Display_Statute&URL=Ch0790/ch0790.htm Unrelated. I had to call the state today to find out the status of my license only to find out that the state approved it back on Aug 13th and I have not received it in the mail. The nice lady on the phone said she would send in a request to have a replacement sent. I dunno if i will be required to send in another passport photo, anyone here ever lose a CWL ? |
Poor guy almost sounds like he was suffering from dementia or early stage Alzheimer's and got confused. If that's the case, they'll probably drop charges and ask for him to surrender his CCW permit. As far as taking the CCW class, its well worth it to do so. Should you ever be in a shooting, the more formal instruction you have documented under your belt the better off you'll be from a legal standpoint. |
When did the requirements change. I had been out for about 3 years before I sent my copy in with the packet and fingerprints and received my permit. I've never heard of the 6 month rule. Where can I find this rule? |
I sent mine in several years after my discharge as well. |
Maybe that was a Texas thing. That is what I was told when I got my first CCL back in Texas in 1999. Had been discharged since 1993, and was told UH-UH, take the course. |
everyones' photo looks bad. don't worry its normal. They have some form of photo shop it;s just the Dirt Bag edition. J |
Good How many days did it take, mine was aboout a month. On mine I look I cop that is going to jail, (not a good pic) I look pissed. |
well i did electronic fingerprints, i mailed my app in about a week before the miners in utah were trapped underground. Had the first one not gotten lost in the mail and had i called sooner about it, i would have gotten it on or around august 13th. so about two weeks time via electronic finger print submission. comes with a pamphlet and a notice about other states that will honor your resident concealed weapons license. |
Close. You cannot carry in that portion of an establishment licensed to dispense alcoholic beverages. That's why you can go th Applebee's, but stay out of the bar area. It's not like Texas' 51% rule, but the area where they actually dispense the drinks. |
If it fits based on the statute 790.06, which it looks like it does: (h) Demonstrates competence with a firearm by any one of the following: 1. Completion of any hunter education or hunter safety course approved by the Fish and Wildlife Conservation Commission or a similar agency of another state; 2. Completion of any National Rifle Association firearms safety or training course; 3. Completion of any firearms safety or training course or class available to the general public offered by a law enforcement, junior college, college, or private or public institution or organization or firearms training school, utilizing instructors certified by the National Rifle Association, Criminal Justice Standards and Training Commission, or the Department of Agriculture and Consumer Services; 4. Completion of any law enforcement firearms safety or training course or class offered for security guards, investigators, special deputies, or any division or subdivision of law enforcement or security enforcement; 5. Presents evidence of equivalent experience with a firearm through participation in organized shooting competition or military service; 6. Is licensed or has been licensed to carry a firearm in this state or a county or municipality of this state, unless such license has been revoked for cause; or 7. Completion of any firearms training or safety course or class conducted by a state-certified or National Rifle Association certified firearms instructor; A photocopy of a certificate of completion of any of the courses or classes; or an affidavit from the instructor, school, club, organization, or group that conducted or taught said course or class attesting to the completion of the course or class by the applicant; or a copy of any document which shows completion of the course or class or evidences participation in firearms competition shall constitute evidence of qualification under this paragraph; any person who conducts a course pursuant to subparagraph 2., subparagraph 3., or subparagraph 7., or who, as an instructor, attests to the completion of such courses, must maintain records certifying that he or she observed the student safely handle and discharge the firearm; |

1BMF, Yes it will. Just send a copy of the paperwork, that the firearms instructor gives you, showing you qualified and what your score was.(forget the name of the form off hand). Sent a copy of my "G" completion form, and recieved my concealed license in 63 days door to door with paper prints, a year and a half ago. I'm sure the "G" instructor will also advise you of this too. |
| I took the FL Hunter's Safety course when I turned 15. Didn't cost anything, and it counts for the class requirement. I still plan to take a crash course that covers when/when not to draw down, the restrictions on CCW, etc., just because I think it will be personally valuable to me. |
hey thats my line.... |
my dad sent his in 30 years after his discharge and it was accepted. |
take a real defensive handgun class not the BS NRA safety course. |
You do know that the NRA has two semi-tactical courses that are NOT considered safety courses, right? |
Did you even read the second half of my post? My point was that the hunter's safety course satisfies the legal requirement, but further training would be prudent. |
