| I want to get an mp5 or clone. I want it to be an sbr, so am I better off getting a pistol build from someone like dakota or ghillie which are made off of kits or buying an sw5 or coharie and doing the work to it? I really appreciate the help |

I was in the same boat . 6 months wait for SBR so why not get a solid built MP5 pistol from one of hte 2 you listed. SO I got in line for a D54P and have my Form 1 and NFA trust all set.
Rather enjoy a pistol during the long wait .oh plus once its a pistol THEN an SBR , you could always go back to it being just a pistol if you get tired of the NFA world |
| If you don't plan on getting a sear, MKE, if you can find one(I believe there's still one floating on EE). If you want the sports car, Dakota Tactical or a Ghillie built is the way to go, plus, you can install a sear in those. Not sure what PolishX is saying, but once you turn your pistol into a rifle, you can't turn back. |
This is true. ATF has said the Pistol -> Rifle -> Pistol issue is only for Thompson Contender. Once you put a buttstock on a pistol reciever, its a rifle and will be forever more.
ETA: Well now I am confused. ATF Ruling 2011-4 Held further, a firearm, as defined by 26 U.S.C. 5845(a)(3) and (a)(4), is not made when a pistol is attached to a part or parts designed to convert the pistol into a rifle with a barrel of 16 inches or more in length, and the parts are later unassembled in a configuration not regulated under the NFA (e.g., as a pistol).

Would like to check on how everyone is reading the current BATFE rulings on Pistols, Rifles, SBRs and the conversions between these configurations? Of course most of us are not lawyers and/or are not lawyers in the state of the reader, this is for discussion only, all disclaimers apply.
Potentially have multiple cases and combinations, however, to start the discussion will pick two: Case 1: Ones has a Tittle 1 pistol, which is in a pistol configuration, plus you have a "kit" which adds the stock and a barrel of 16" plus inches to make a Tittle 1 Rifle of 26 plus inches in length. My understanding is this is the TC case and there is no issue have both the pistol and the rife conversion kit, and most likely you can move between the two conditions (i.e pistol and rifle) as long as you make only the legal combinations (or at the very least you can go once from the pistol to rifle configuration). Thanks guys for the link to ATF Rule 2011-4 Dated July 25 2011: http://www.atf.gov/regulations-rulings/rulings/atf-rulings/atf-ruling-2011-4.pdf Case 2: You start with a Tittle 1 pistol which is converted to a Tittle 2 SBR with a barrel less than 16" and/or an OAL of less then 26 inches, with the proper approved paper work (i.e. Form 1) and markings. My understanding is that you can temporarily change barrel length including making the SBR back into a legal Tittle 1 rifle (i.e. add a 16 barreled upper to a SBR AR15) and while in the Tittle 1 Rifle condition take it across state lines to hunt with, loan or even sell, as long as the items needed to make it a Tittle 2 SBR are not present (or under your control if you are not the SBR owner). While to keep things clean you can send in updates or request removing from the registry as each case indicates. Which is due to the Tittle 2 SBR status being defined as the combination of parts, not just the receiver (i.e. unlike machinegun, for a SBR you are registering a rifle with a short barrel and/or short overall length). With the current pricing it is nearly not worth the effort to restore a SBR AR15 back to the "Pistol" configuration and status, however, for currently higher cost conversions, such as a SBR made from a German SP-89 pistol, there are times when it would be a reasonable and/or useful option.
