Can I build a SBR with a pistol buffer tube while I wait on my Tax Stamp approval?  I was thinking about building a 300 Blkout with an 8.5 barrel and just putting a pistol buffer tube on it instead of a stock.  Is that okay or should I say legal?

If the receiver wasn't first built into a rifle, then yes building a pistol would be perfectly legal.

If the receiver wasn't first built into a rifle, then yes building a pistol would be perfectly legal.


What do you mean if the receiver wasn't first built into a rifle?  I purchased the lower receiver separate and built everything, just don't have the barrel or buffer yet.

He means exactly what he said. If you initially take that lower and build a rifle (I.e. add a stock), then it is initially a rifle, and when you remove the stock to make an AR pistol it becomes a "weapon made from a rifle".

If you take that stripped lower and the first configuration is an AR pistol, you're good to go.

...and no, there's no way anybody would ever know unless you post about it in words or pics.
