I recently applied to city hall to get a home based business permit.  I was approved and received it but the problem I have is that it states in no uncertain terms that “there can be no customers at the home.”  My plan is to do internet sales and gun shows only.  I am approved on the permit for internet sales and obviously need an FFL to do that.  So, what sayeth the hive?  Is this going to be a sticking point in the interview when they ask to see the permit?  Wisconsin does have preemption law but I'd like to avoid the lawyer route if possible.  Thanks!

I don't see an issue. If memory serves me, you should just need a letter from the local zoning board stating you can have a home business. If it is an issue you should be able to obtain a zoning variance to allow foot traffic as I'm sure there has to be some legal in home day cares or barber shops in your area.

I do have that, they call it a Home Based Business Permit.  On said permit they are explicit in that they do not want any foot traffic from customers to the house.  If there are any such businesses (home day cares or barber shops) I don't know of them and based on my conversation with the zoning administrator all he really cares about is the zero foot traffic thing.  That said I didn't tell him I was applying for an FFL I just told him that I am starting an internet sales company.  I didn't want to push things too hard because of the polarizing effect firearms have on people.  I have it on fairly good authority that this shouldn't be an issue but I have also heard "around the net' that this may hold things up.  Since I'm in the waiting phase I just figured I'd ask around and see what the consensus is.  I do hope that I'm just overreacting we all know how weird the government can be about these things.

Well, if ATF denies you your FFL for zoning or whatever, they'll refund you money. So worst case you're out your time.

Chances are the IOI will call your local zoning officials and verify the validity of permit, and ask questions. Be up front, not a good way to start off trying to hide information.

I'm not sure how I'm "hiding" information.  I was never asked by anyone, including the zoning admin when I met with him, what I was selling.  I was asked what type of business I was starting and I told him internet sales and some trade shows.

Well if it comes down to it I can always challenge their decision based on my states firearm preemption law.  By "their decision" I mean the zoning office not the ATF.

66.0409  Local regulation of firearms.
(1) In this section:
(a) "Firearm" has the meaning given in s. 167.31 (1) (c).
(b) "Political subdivision" means a city, village, town or county.
(c) "Sport shooting range" means an area designed and operated for the practice of weapons used in hunting, skeet shooting and similar sport shooting.
(2) Except as provided in subs. (3) and (4), no political subdivision may enact an ordinance or adopt a resolution that regulates the sale, purchase, purchase delay, transfer, ownership, use, keeping, possession, bearing, transportation, licensing, permitting, registration or taxation of any firearm or part of a firearm, including ammunition and reloader components, unless the ordinance or resolution is the same as or similar to, and no more stringent than, a state statute.

I was denied for this very reason 2 yrs ago.  Interviewer originally said before leaving, "looks good - shouldn't be a problem".  2 was later, DENIED.  Spoke with guy that interviewed me and his boss.  Said the issue was that my city business permit did not allow foot traffic to door!  Sucks.  Can't wait to retire and move away!

Had my interview last Thursday.  IOI said I was in the clear.  Was very nice, helpful, and just overall a good guy.

FFL in hand today.  Turns out the zoning was a non-isuue.
