So, in the process of starting a home based FFL I  was stopped  by our Home Owners Association.  

Thinking about my options. I have looked into opening a store, which is possible.

Is there any way of creating an Online FFL to get around the Home Owners Association? I'm thinking it's going to have to be a store Front


My 2nd Question,
If I decide to open a store, Do I need to lease a building before even applying for an FFL? Since it requires an Address

 No matter what/when/where/why/how/with whom you choose to do business as an FFL, you will have to have a physical premises address from which it is legal to conduct your business.

If you rent that premises, you will need the written permission of your landlord.

You cannot get an FFL without a physical address from which anything up to and including walk-up retail sales are legal, even if you don't intend to do anything except "online" activities.

You'll have to have a physical address, and the permission of the owner (landlord) if you do not own it yourself.  You could accomplish that with something like a memorandum of understanding to lease a space, contingent upon getting your FFL in hand, but it will have to be narrowed down to one physical address in order to send in the application.

what ways around the HOA? Mine claims I can't run ANY home based business in my division. HOA lawyer pointed at the portion of the CCR's that says that ever lot will be used for a residential home only and no commericial activity.

How can you get around them saying "NO".??

I'm not sure how you would, but some HOAs don't mess around - if they have a lawyer then I'm willing to bet they'd fine you or even place a lien on your home if you violate the covenants. I'd read over the covenants and see what powers they have. Is getting an FFL worth all that?

Yes, HOA said absolutely no business out of our home.  I will be finding a retail location in the county

Great...live outside the HOA in the ghetto or the country. Unfortunatly around these parts that's what's left - poor ghettos and poor rednecks. Nothing worth owning..oh well

They have the power and means to shut you down.

If you find a loophole in the rules, they can change the rules.

Forget it

Your HOA controlles the largest investment you have

your home

They dictate what you can do

How many people can live there

How many and what type of vehicles you can drive

The color of the house.

The length of your grass.

All you get to do is Pay the mortgage payment and the HOA dues.

Nonsense. Here in DFW I know of a dozen or more FFLs that operate from homes governed by HOAs.
