I am an 01 and 07 and I was considering an SOT. I have a few ?s
1) I am in DE, we cannot have FA or supression. Where can I find out about SBRs, and whether SBS or AOW is allowed? I am guessing it would be via the State, but is there an ATF resource for this? 2) Is it worth it to get either? 3) Will a Class 2 cover me for manufacturing and selling, or would I need both? 4) Do I have to pay the $200 tax stamp for what I manufacture, or is that paid by the end user? Any other guidance you guys can give me would be very helpful! TIA, Scott |

1) look up the state laws.... i cant help you much here
2) maybe, it depends on how what you value and your intent in getting it. 3)class 2 covers both 4)no, you dotn have to pay any taxes to make or transfer (unless you buy somthign from a nonSOT on a form4) if you get one you may as well get the C2. i dont see any downsides to doing so. |

Or are they for two different sites and businesses? 1) I am in DE, we cannot have FA or supression. Where can I find out about SBRs, and whether SBS or AOW is allowed? When you got your FFL's you should have been given a 3/4" thick book with a white soft cover. This book has the gun control laws for all 50 states. 2) Is it worth it to get either?
We think so, but residents of our state aren't limited to what they can own, either. 3) Will a Class 2 cover me for manufacturing and selling, or would I need both?
A 07 FFL / 2 SOT can manufacture and deal. An 01 FFL / 3 SOT can only deal. 4) Do I have to pay the $200 tax stamp for what I manufacture, or is that paid by the end user?
SOT's do not pay transfer taxes for firearms they manufacture or transfer to/from another SOT. Manufactured firearms are added into the NFRTR using an ATF Form 2. |

When I applied I was told by the ATF agent (on the phone) that 07s weren't dealers and had to sell to dealers and not retail...at least this was my understanding. They had no problem taking the money... :) Sounds like the 02 is the way to go. I might not renew my 01 either. Yes I do have the book you are referring to. Exactly what I was looking for. Thanks I checked out the Form 2, what is NFRTR though? Is it legal for me to possess (for sale) NFA items for sale to other states, if they are not legal in my state? Or am I exempt because of my SOT? And as far as the transfer tax, that is always paid for by the end user correct? Thanks Bubbles! |

you seen very new to NFA related things so I think your best bet would be to go to the ATF site and download the NFA handbook and read it. It should give you the basics on the NFA and should answer your questiosn here. That's perfect...I wish i knew it existed, it would of saved my some typing |
