| I'm fairly new to the licensed gun business as most of you know. So I have a question. If you get a delay at a gun show and the buyer lives some miles from the shop how do you handle telling him he has to wait. |

Not an FFL.... but wouldn't you be able to get his info from NCIS? Also, why did you let him get that close to his 4473? Did he go behind the counter or something? |

I guess lessons learned: 1) Get money first. 2) Keep customer away from forms once he has filled them out. |

If this happened to me I would call the police immediately.
If you've not yet contacted ATF shame on you. That should have been done last Saturday. The completed Form 4473 is a federal document that I AM REQUIRED by law to have in my possession. I'm not going to jeopardize my license because some asshole gets mad at the results of his NICS check. A dealer is required to keep that 4473 even if the NICS comes back as "denied". IMHO it is no different than him grabbing the gun and making a run for the door. Oh..........get the $$$$$ first. Always. |
| First of all you are not the first FFL this has happened to. Secondly, I'd call ATF (industry side) and let them know about the situation. Tell them all the info you have, they should make a note of the situation. They do not expect you to tackle the guy and get the form back. |

We tell them they have been delayed and the FBI will not tell us why, it could be similar name etc. The FBI has three business days to conduct further background check and after the three days are up if we have not received an answer the transfer can be completed. It is possible that we will receive an answer sooner and if you want to leave a phone number we will call you as soon as we get the answer. (Most gun shows in our area stamp peoples hands and they get in free if they return or come in Sunday. So we sometimes get lucky and the person can come back and get their gun ) If we do not hear from the FBI before the show ends you have a few options: 1. Not buy the gun and the 4473 will be filed as uncompleted 2. Travel to our store and pick it up 3. Have it sent to your local FFL, however the shipping is added to the cost. So far we have never had an irrate customer, we simply tell them the FBI says yes, no, or delay and that is all we know. |

I guess I'm a little confused.
Here in The Peoples Socialist Republic of Illinois we have a 24hr wait for long guns and a 72hr wait for handguns. We don't make NICS calls, instead we call The Illinois State Police. Its an automated phone system and approx. 50% of the calls end up in a "delay" situation. Most of the time this is due to the computers being busy. If it were a long gun and I would still allow them to take it the next day as I have no reason to say NO unless I receive a call saying that its denied. I'd say its the ISP's responsibility to get the job done before the time expires and in every situation they have. |

Illinois is one of thirteen states that do not use the free FBI NICS check (eight more are POC for handguns only). They are considered a "POC" or Point of Contact. This means in those states there is an agency (often the state police) designated to perform the background check as required by the Brady Law. |
