As I wait for my first Form 1 for approval, is it possible to purchase the SBR upper and have it shipped (and keep it off of any firearms) or do I need to ship it to a dealer?

You can ship the SBR upper to yourself, and technically, you can do it now. You do not need a dealer.
However, you do not want to be in possession of an SBR upper without a legal lower to attach it to (pistol or approved SBR lower). If you already have a built lower with a stock, you either need to wait until the approved form is returned, or have a friend/relative take possession of the upper for the time being. |

There is no requirement to have an upper shipped to a dealer because it's not a serialized item. They will not show up in the middle of the night and raid your house because you ordered an upper with a pending F1. |

Unless you give the cops another reason to search your house, you will not have a problem posessing the shorty upper while waiting for the F1. Even if found that way, you can prove intent to comply with the law by demonstrating the pending F1, unless you were stupid enough to attach the upper to a non-SBR lower, which I assume you are not.
The BATF is NOT waiting behind your shrubbery to serve you with a warrant as soon as you take delivery of the upper. |
