I'm moving to a free state and one of the first nfa things I want to do is have a sbr.  One question I have is it legal to have an extra short barrel upper for your sbr?

yes you can have as many short barreled uppers as you want for your regestered lower...but you don't want any non regestered lowers lying around as the SBR uppers are easily attached to non regestered lowers and you have "constructive intent" as BATFE see's it.

Didn't start this thread but I have to ask... So you keep them in different safes or something? I want to get a 9mm upper to put on my SBR lower in addition to my 11.5 5.56 upper.  I've got 2 other AR's so what do I do?  That seems like some bullshit.

You don't worry about it.  If you have lowers sitting around with no corresponding uppers, i.e. one of your other ARs doesn't have an upper, then ATF could possibly hem you up for having multiple short uppers.

Just buy an extra AR receiver or two and put the short uppers on them. Receivers are neither pistols nor rifles until you assemble them.

As long as the lowers don't have stocks (and never did have stocks... and you don't own extra stocks) you would not be in violation because - by default - the AR lowers with short AR uppers without stocks are pistols not rifles - until a stock is added. Under federal regulations, rifles must have/had a stock - period.

On a final note... just remember DO NOT add a vertical foregrip to an upper on a pistol as the pistol would be considered and AOW - and hence would be an NFA item like an SBR.

When I purchase a lower my FFL calls it in as a long gun unless it is a pistol then he tells them it is a handgun.  The lower is either a pistol or a rifle.

Someone please correct me if I'm wrong.

The 4473 asks if it is either a rifle, handgun or other. A stripped receiver is classified as "other" since it can be built either way. They made this change a few years ago. Not sure about the NICS check, but what's down on the 4473 is what matters. If it is done right, he puts down "other" for a stripped receiver.

Stripped lower should be called in as an other so the guy above either hasn't bought one since the change or his dealer still has a big stack of the old 4473 forms(which shouldn't be good any more iirc).

I would say if you have an sbr lower and a pistol lower you should be gtg but the BATFE get to interpret or make the rules as they go so do some research and make your own decision.
