I know you can buy chalk markers, but can you purchase smoke?

I have looked on various websites and only a Hazmat fee is mentioned.

No stamp need for smokes.



HE rounds (if you could even find a dealer to sell it to you) would also requires special storage requirements.

the HE rounds wouldn't need a stamp since you would have an explosives license, although no one would sell them to you.
if you have an explosives license and buy a brick of C4 you don't have to pay a tax stamp on that.

I don't know the specifics as to how a 40mm HE is regulated under Federal explosives laws, but for purposes of the National Firearms Act, it most certainly is regulated as a DD and is required to be registered as such.

26 U.S.C. sec. 5845(f)
"The term destructive device means

1) any explosive, incendiary or poison gas A) bomb B) grenade C) rocket having propellant charge of more than four ounces D) missile having an explosive or incendiary charge of more than one-quarter ounce E) mine, or F) similar device

Even though, by nomenclature, it is called a '40mm grenade', under Federal Law, it is classified as being a missile due to it being designed, and only being capable, of being used as a projectile. If 40mm ammo was considered to be a 'grenade' as it's defined under the NFA, then all 40mm grenades would be NFA items to include each M781 practice chalk round.
The reason that a block of C4 isn't considered a DD under NFA is that it doesn't fit into the statutory definition of a DD. C4 in and of itself is just an explosive. Now if you take the C4 and pack nails around it, attach a detonator & timer, and place it in a shopping mall, then you've just created a DD (bomb) as you've just turned what was just an explosive into a weapon.

i know there are a few civilian companies out there who have 40mm HE rounds, i can't remember who though.  asking them how their 40MM he rounds are kept is really the only way to answer this.
