My dealer got my form 4 back because he forgot to sign it.   Big stamp on the front rejected.  Had to fill out new forms, get new pictures, get CLEO signature and write a new check.  Then mail all this back to ATF.  Dealer said that he had talked to a rep at ATF and was told that it would expedited when it came back.  That was two weeks ago, so I called today to check status and was told that because it was "disapproved" that I would have to start the wait process all over again from the beginning.

Anyone have any experience with this?  Who should I believe?  I am more than a little ticked right now.

What was the reason for disapproval?

Any reason in particular that you don't have a trust?

Call the ATF and see if you can find out the history of your Form 4. See if it ever went into error status. If it did, that was the window for you to correct the errors and mail it back to them and retain your place in line.

If it was an outright disapproval, then there is nothing you can do except start all over again.

It's hard for me to believe that the dealer forgetting to sign it would be an outright disapproval.

Error letters are supposed to go to the transferor, but some people have said they send a courtesy copy to the transferee as well.

Not much you can really do at this point, but it would be interesting to see if your dealer ignored/failed to respond to an error letter.

Better believe it. It's something they've started doing more and more this year. I know local dealer sent in a stack of a dozen or more back in Jan, and missed signing one. It was rejected instead of having an error letter sent. Talked to one of the Section Chiefs at SHOT and she said they were rejecting them instead of moving them to problem status.

Sucks to have this happen, but I wholeheartedly agree with this tactic. It'll speed up the process substantially in the end. Nothing will get people to review the application more carefully than the threat of having to start over if there is a mistake. Problem Status is a serious impediment to efficiency, it should go away.

I don't understand how dealers make mistakes on these forms. With this being a lengthy process you would think that they would double and triple check them for errors before mailing them. I just had this happen with a form 3, so not a big deal for me other than waiting.

Agree. I shudder to think how many emails Ted Clutter gets from bubbas who forgot to sign their forms, picked stupid "reason to own" answers, have invalid trusts, etc. If you send a bad application you should have to start over.

Yup. Sometimes you just miss a detail. I had a form that wasn't signed by my dealer and I didn't discover it until he went out of the country for three months.

Shit happens. I know I've had similar errors on 4473's in the past. Fill out a few thousand forms and you are bound to miss something eventually.

Mine was a form 3 done by a dealer in PA for transfer to my dealer in MS, so I never saw it. Double checking a form 3/4 takes only seconds...

This exact thing happened to me in the last week except mine was a form 4 as a trust, silencer shop did all the paperwork, sent it to my dealer and all they had to do was sign it (boxes 10 & 11) before sending it to ATF. How my dealer failed to sign it is beyond my understanding. When I talked with the ATF rep who was listed on my form 4 she said I had to start all over, end of the line, resubmit all paperwork. They had already started processing a refund for the tax stamp. My form 4 came back with a giant red stamp on it that said "RETURN WITHOUT ACTION" and the disapproved box checked and written in it was "No Signature".

She said they are only four months out on form 4 as a trust. What a big comfort.

Silencer Shop is going above and beyond. They actually apologized to me for my dealer's mistake, are sending a new packet of paperwork (to me this time), and I found out that months ago SS silently paid my dealer triple for the transfer when my dealer demanded more money than they originally quoted. I'll be looking for a new dealer for the next one.

Here is what I got back today:

"Per Ted Clutter’s request, I am writing you in regards to the application with serial number_______ that was returned to you without action because the signature was missing.  I am sorry for you, however, this is our policy now that applications are returned.  This application was not “disapproved”, it was stamped “return without action”.  You stated that new forms were submitted on May 29, we have not received them from the bank in GA to be entered into our database.  You also, stated that you were told that you would have to start over with the processing time.  Your application will not be as long getting back to you if everything is in place.  I hope that this clarifies your concerns.

Sorry, for the inconvenience as soon as we receive the paperwork we can process for you…

Have a great afternoon"

So we will see how things go.

Nobody is perfect and things happen and that is just life.

Happy customers are repeat customers.  My stuff gets the fine tooth comb before I send it or give it to the customer.
