I was wondering if its posable to buy a lower receiver and then buy an upper? I want a Bushmaster 16" Upper and a lower with a telescoping stock.

Yes.
IANAL, but as I understand it, the lower must have existed as a complete rifle prior to the ban.
Sounds like you might want to ask this over in the legal section, imho.
