I need money badly right now so I'm going to try and sell my MP5 clone, it's an SBR.
So a couple things I want advise or opinions on. It needs refinished bad, for $270 for a Cerakote job how much value can I expect to add? Also it's already an SBR so there's one tax stamp. I have a suppressor I run on a 3 lug mount and I would consider including as a package. Would the package be potentially easier to sell or should I sell just the gun? |

If it's out-of-state, that's when you have the double transfer (2x $200) and dealer involved. |

I think by best bet is to convert to a pistol but everywhere I see says to install 16 inch barrel but I would much rather put a pistol end cap on it and go pistol not rifle. I need to call the ATF and see if that's an option. |

I need to call the ATF and see if that's an option. That's the right way to do it, replace the stock with a pistol end cap and sell it in pistol form. Nobody wants an mp5 with a 16" barrel. |

I still haven't seen something that says it's ok with a sbr. In my mind it is different because when you form 1 it you have started from scratch and now it's a clean slate rifle. Opinions differ though so I would love to see a official ruling. |
| I don't know anything about MP5s. Are they similar to AR's in that they have a decent market for the parts? I've always figured that if it came to it with my ARs, I'd just part them out and keep the stamped receivers. Then again, a Form 1 gun is likely worth far less than a Form 4 gun since it has my name engraved on the side. |

That's a good question, and one we have discussed before. One side says if it starts out as a pistol, then SBR, then it shouldn't be any legal issue to go back to pistol. The other side says that once it's SBR'd, any further firearm made from it is made from a rifle (by definition!) so you don't get the pistol>rifle>pistol exemption. Me? I think if it came to a judge and jury it would NOT be legal to convert an SBR to a pistol and have it be Title I, as the pistol would demonstrably have been made from a rifle. The legal question is, "Once a pistol is made into an SBR, does it's prior status as a Title I pistol have any legal bearing on future configurations?" There is honest disagreement on the subject. ETA, and for the love of Joseph, please don't write any letters! |
