Was thinking of a hypothetical situation earlier. Say a person was in the process of moving, from one state to another. A form 4 for a suppressor is approved after he/she leaves state A but before becoming an official resident of state B. If it is not conducive for them to travel back to state A anytime soon, would it be possible to fill out a form 3 along with a .20 address change and have the can sent to an NFA dealer in state B? Is there any way around traveling back to state A besides starting the entire process over?

As an individual, once you sell/move out of your home and leave State A you are no longer a resident and the dealer in State A would no longer be able to transfer the gun to you even if the Form 4 was already approved.

If you submitted the Form 4 as an individual, then you'd have to cancel the current Form 4, have the dealer Form 3 to a dealer in State B, then resubmit a Form 4 as a resident of State B. A lot of time is lost if you have to move out of state before the Form 4 is approved.

If you submitted as a Trust, then any trustee who still resides in State A can pick-up the firearm from the dealer after the Form 4 is approved. You could go back to State A and pick it up from that trustee, then take it back to State B. They could also ship it directly to you as well.

Just to add to Homeinvader's thorough answer...it has to transfer to you (or a trustee, etc) on a tax paid F4. You can go F3 -> F4, but you can't go F4 -> F3. The F3 is a tax-free transfer between dealers.

If you call or email the NFA branch and politely explain the situation, I bet they expedite you.

You would have to cancel the Form 4 (allowable since the NFA item hasn't been physically transferred yet), then Form 3 to your new in state dealer, then do another Form 4.
