I was reading over some of the threads on efiling a form 1 with a trust for a SBR and came across someone who was denied because they did not put the word "The" in front of their trust name.  

When I created my trust, it was simply my last name and the word "trust", no "The" in front of it.  Of course the paperwork says "Declaration of the XXX trust."

So, when I submit it, should I put "The XXX trust" or simply "XXX trust"?

Sorry if over-thinking it, but it does seem to be pretty specific.

Should just be XXXX Trust. I put The XXXX Trust because it was apart of the name. They are looking at the trust docs that you upload and if they don't match, that is where the problem comes from.

Someone else may say differently....I'm new but that seems to be what I've read.

Capitalization, formatting (bold or italic, for instance) and punctuation should indicate whether "the" is part of the title.

For example...the first section in the body of my trust says:




And then the Cert of Trust says:




The first one got me in trouble. I filed my first two paper forms were put into problem status because I filed as Lastname Living Trust. Based on the bold part in "quotes", they expected to see all of that as the applicant. You can see on the Cert that the bold part is the same as what I filed.

Instead of changing my forms, I submitted an Amendment to clarify the name did not include the date portion of the first pic. I still has two EForms Disapproved for the name not matching, and ended up getting them reversed after explaining my case.

I even had a couple paper forms later on get out into problem status for name not matching. The research assistant even admitted she didn't read the Amendment because "I've never seen one address the trust name, it's usually adding or removing trustees and/or beneficiaries". I now have the Amendment as the first section with a post-it note scanned onto the cover sheet explaining why the Amendment is there, and also upload (for all Eforms) a .doc file that explains it as well in a couple sentences.

My lawyer suggested against trying to be cute (with something like the In God We Trust; I actually wanted to use an acronym associated with my line of work in the .mil) and to designate it as an NFA trust (in case you have or end up with other trust(s)).

NAME NFA TRUST...NFA optional.

You are going to have to engrave it on everything you form 1.  The more letters, the more chances of mess ups.

Unless your last name is ridiculously long/difficult, I would just use your LAST NAME, TRUST and keep it at that.

Plus, some engravers charge by the letter, so there is always that...

Most of you are missing the point. The trust has already been named. He's having an issue about how it was submitted vs what the trust doc shows.

Thankfully I had not submitted it yet (guess efile is down each Wednesday for maintenance) so as I was reading over some last minute recommendations, I noticed this and wanted to get some clarification.

45 - 60 days seems fairly short from what it used to be, but I just want to make sure that I don't give anyone any reason to kick me back.

So all of my F1s, whether paper or eForm, all have Lastname Living Trust. All of my paper F4s have the same thing. However, my one eForm 4 has The Lastname Living Trust. The dealer had a form to fill out online, then they filled input the info into EFORMS. No idea why they added the "The", but luckily it was approved.
