| I was asked this question by somone today, and I really don't know the answer. A Form 4 was submitted for 2 suppressors on a trust. Three months into it the guy dies. The benificiarie of the trust wants to know what to do, and how he can get the suppressors. I said that he needs to call the ATF or talk to a lawyer. Has anyone herd of this situation and what happened? |

Where did you find this information? Is this information state specific? It can be both trust-specific and state-specific. Trusts are legal entities created to hold property for beneficiaries. Depending on how your attorney words them, they may or may not require distribution of assets -- i.e., a transfer -- upon the death of the creator. Some states do allow "trusts in perpetuity," which do not have to be dissolved upon death, but again, it depends on how your attorney worded it. Bottom line is, ask the attorney who created your trust. That's the sort of guidance you are paying for when you hire him. |

I know it's off-topic but at the rate things are going I fear I may die before my currently pending Form 1 is approved. And I'm only 42 I'm right there with you on age, and I have 3 Form 4s pending. Two should hopefully be approved around Oct/Nov for 2 Mini4s (one for my SBR, 1 for my day's SBR) and probably Feb/Mar for my 6933. |

Ohhhh...I get it now. I missed the question mark in the subject line. I thought this was a discussion about the new BATFE slogan regarding transfer times: "DEATH BEFORE APPROVAL!" P.S. If the examiner for any of my current transfers is reading this, the above was a joke. Just because I do not constantly call to inquire about the status of submitted forms does not mean I do not love you. |
