| So I recently got an SBR approved that took 16 months. If I were to try a SBR AR upper, would the process go any faster the second time? Or is it treated like a brand new application (fingerprint check etc.) |

Or is it treated like a brand new application (fingerprint check etc.) To answer your question though, it WILL be treated like a new application, which it is. Unfortunately, there is no "you are in the system" for NFA. Every application is treated separately and it all depends on the assigned examiner and the workload. Your wait SHOULD most likely be MUCH less than 16 months, as that is crazy long, but it has nothing to do with it being your second time to the rodeo, only that the first was unusual. Figure on 6 months.... if everything is in order when you send it. |

So I recently got an SBR approved that took 16 months. If I were to try a SBR AR upper, would the process go any faster the second time? As noted, 16 months is really long. I just had a Form 5 (transfering from a PD to an individual. Prints, photos, etc. Same as a Form 4) that took just under 2 months from the time ATF received it to approved. And I should point out that an AR15 upper is not a "firearm". It's just parts. You have to register the part that's considered the "firearm". In the case of an AR15, that would be the lower receiver. The nice part there is that, once registered, you can swap around a bunch of different uppers with various barrel lengths / calibers / configurations with just the one registered lower. |

To buy an SBR upper, your wait time should be approximately the time it takes for your credit card to go through. Shouldn't be any longer than a minute in most cases.
(Buying an upper doesn't require NFA registration. You only register the lower. And you can use multiple uppers on that lower.) ETA: 16 months is ridiculous. Did you ever get an explanation for the delay? |
|
Ok thanks for the explanation guys.
Delays were: fingerprints rejected, had to do them twice. Each time took 3 months to even look at them. FFL/SOT moved locations and had to do paperwork to correct it. FFL/SOT was out of the country for 6 weeks. Sheriff was out of town at first so it delayed signature for 2 weeks. Other than that it just took a very long time to do each stage of the process. I finally got my item, but am pretty ETA: So my question is, I currently have a Colt 6920. Which form would I fill out to register the lower? And then once approved I can just buy an upper right away? |

You'll also need the finger print cards, citizenship form, and your lower will have to be engraved. Just to clarify, you already bought an SBR in the past and currently have it registered? If so, you could go ahead and buy that upper now if you want. |
