My form 1 was written up based on a 7.5 inch upper, which I currently have built up and using on the stamped lower. I have a 10.5 inch Noveske coming. I know as long as I keep the 7.5 inch upper around, I can put any other upper on this lower. But I'm wanting to sell the 7.5 inch if I go with this 10.5. Is a letter to the ATF requesting this barrel length change on the form 1 all I need to do? Is the letter sent to the same address where the form 1 went? I know there is a thread out there that explains this scenario but I don't have 2 hours to spend searching for it. |

Yup. Send the letter to the same W.Va. address as the Form 1.
Say you are the registered owner of SBR SN 12345 and that you are pemanently changing the config to BBL length xx" and OA length ZZ". Send the letter in duplicate and ask that they stamp/sign one copy as "received," and mail it bak to ya in the stamped self-addressed envelope you include. It's also helpful to attach a copy of your Form 1, just to make sure they change the correct entry. You should get the stamped copy back in a couple of weeks. You will get an official notification once it is entered into the system –– that takes about two years.

I have several SBR's that were registered with several calibers on the form 1s. I had to select a barrel length so I put in 11.5". I am planning to build a 9mm upper with a shorter barrel then the 11.5" as it was originally registered. I was planning to send an update letter to the ATF informing them of the caliber and barrel length of my new upper that will be used on this SBRed Lower. I believe that is all I have to do to keep my SBRed lower legal.
Any thoughts on this? Dane Repeal & Replace ! |

Are you permanently changing the registered configuration, as in, getting rid of the original barrel? If you are just putting together an ADDITIONAL upper to use with your SBR, you don't have to do anything. If you are getting rid of the original barrel and replacing it with the new 9mm barrel, it would be a good idea to write a registry change letter to NFA Branch. |
