Scenario:

I live in Dallas, TX...CLEO will NOT sign the Form 1.

The business I own is in another town (near Dallas, TX) and that towns CLEO will sign off on the Form 1.

The Form 1 asks for a "mailing address" not a residence address.

Here's my question...can I use my business address on the Form 1 in lieu of my residence address?  The SBR can be kept and stored safely at my business.

if that is in fact your business and that is where the NFA item will be stored.... sure I cant see why that would not fly.

Your friendly CLEO where your business is located may not want to perjure himself. If you read what he has to sign...."I certify that I am the chief enforcement officer of the organization named below having jurisdiction in the area of residence of". Technically, your business in not your residence but he may be a 'good Joe' and not mind lying for you. Personally I wouldn't open up that can of worms too much at stake.

OK, point taken but if in block 2 I select business or entity then using the business address is good to go?  thoughts?  please keep in mind I am not trying to do anything illegal.  if it is not possible then I will go the trust route.  i am only looking for input and opinions from this forum...thanks!

If you select 'business or entity' then it is no longer an 'Individual' application. If you plan to have your business own the NFA weapon, then a CLEO sign-off isn't even needed.

Yes, this is true. No fingerprints or cleo signature is required.
However, proof of a business IS required. Articles of incorporation will do.

Set up a trust for NFA items.  That way your business isn't included in anything.

Got that covered...business docs and permits on file with county and state as well as tax docs from state and feds.  No problem in providing proof.

Just remember that if you use the business approach, the NFA item is registered to the business, not to you.

That means that you must keep the business viable forever; if you close it, or let your permits lapse, the NFA item(s) become unregistered contraband, subject to confiscation and the possessor subject to arrest. The only way to keep it legal is to pay another $200-per-item tax and transfer it/them to yourself (or a trust or to a buyer) prior to closure of the business.

Thank you...point noted!  I just may want to chose the trust route now versus later to avoid that scenario.

THIS IS ABSOLUTLY RIGHT.    I also live in Dallas.  Set up a trust to own your gun.  That way, god forbid somethign happen your business is not on the hook.  It is better than personal ownership anyway because more than one person can possess the weapon (which is true if your company owned it too but they must be employees, with a trust they only need to be trustees which is easy, just make them trustees in the trust document).
