Quick question:

When doing all the Form 4 stuff, does the transfering dealer need to be a class three dealer?

Example:  I have several "regular" firearm dealers in my area.  The closest Class 3 is 2 hours away.  Would the "regular" dealers in my area be able to fill out the paperwork, blah, blah?

Thank you.

Sidenote:  I love this website/forum!  It is such a great place for me (and others) to learn, etc.  A big thank you to all the gun enthusiats, professionals, etc who contribute and especailly to those in charge of running and maintaining.  Thank you!!

Dealer does not need to be an SOT, but he will have to pay for an extra tax stamp for each transfer.

Meaning he would have to pay another $200 on top of mine?...  not likely to do that, or charge it to me...

So bottom line, I would be better off going to the actual C3 dealer farther away?

Thank you.

The SOT allows dealers to do tax-free transfers (Form 3).  If a dealer doesn't have an SOT then the firearm gets transferred on a Form 4.

Depends on what your time is worth, the price of gas your car's fuel economy, etc.  You will have at least one four-hour trip (to pick up the gun), maybe more, if you transfer through an SOT that is a two-hour drive away.

Rgr, thank you.  I'll just go to the actual Class 3 dealer.  Thank you all.

I am confused as to why you even need that other dealer.  Fillijng out the paperwork is pretty easy and trhere are peopel on this forum who can walk you through it step by step.

Well with most transfers from dealers it is ideal for them to fill out the paperwork, as they have most of all the information and can copy/put down exactly what was on the paperwork that came to them via form 4 or form 3.  That is very important as it will make the verification process at the ATF go easier if the info matches what they have on record.  And legally they are supposed to pay the transfer tax, because the entire process is stupid. either way the buyer always pays the tax.

Presumably he is transferring in something from out of state.

using a non class 3 dealer, and instead giving it to him on a EXTRA form 4 is going to add at least 3-4 months if not longer to your already long ass wait. With a double form 4 transfer and then a third form 4 to the final individual, you are looking at a year minimum.

There would be no third Form 4 xfer. If it's coming in from another State from a non SOT person, you will have 2 F4 transfers. From the seler to the dealer, then the dealer to the buyer. If it has to F4 from out of State, you can use a SOT on NON-SOT dealer, it will make no difference.

Now if you are buying from a SOT paid out of State dealer, then yes, use a C3 dealer in your State, it will save time and money.
