I know this has been discussed before, but I can't find it. I'm selling my USSS Rem 870 with 14" barrel. If someone buys it, it obviously has to go to a Class 3 dealer for the transfer.
Do I just ship the shotgun to the Class 3 dealer the buyer specifies once I receive payment? Do I need to inform the BATF of the sale? If so, how. What do I need to do to my Form 4 once it's sold. Throw it away once the transfer goes through? I've never sold a class 3 before and just want to be sure my ducks are in a row. Thanks. |

In the case of a dealer, they'll then F4 it to the actual buyer. If it's out of state, two $200 taxes will be required - keep that in mind for your pricing. Do I need to inform the BATF of the sale? You're not selling a class 3 - which is a type of dealer, not a type of firearm. You're selling a short barreled shotgun, which is a "Title 2" or "NFA" firearm. |

Most title ii non MG private sales need to be in state b/c rarely is the cost able to absorb $400 in taxes and still make sense to the purchaser. |
| So thinking about it some more, I could (technically) inform the BATF that I am converting this back to a factory (non Title 2 NFA) configuration and remove the barrel. Install some POS 18-26" barrel. Once the paperwork goes through. Sell whomever the barrel and receiver seperately and let the buyer register it on a Form 1? |

It can take up to a year to receive a reply from the ATF stating the firearm has been removed from the NFA registry.
You would be better off selling it within your state, and being a factory SBS it will command a premium over someone else's Form 1'ed 870. Maybe mention it is for sale to a few SOTs in your state to see if one would be interested in brokering the deal between you and the in-state buyer for a small fee. Kharn |
