Simple enough situation, I have two lowers with Form 1s out on them, first one went pending earlier this month, second not too far behind.

Larue just shipped a stealth 12" upper to me (they used my billing address to ship to, instead of a neutral 3rd party's). Scheduled to be delivered on Friday.

So my question is if it's waiting there on my porch (don't be trying to steal it ) am I avoiding hot waters by throwing it in my car and driving it over to where it should have gone in the first place?

Not that there's a fleet of ATF black helicopters circling, I just want to make sure I'm being safe about this.

If it's under your control, then you have a Constructive Possession situation going on.  The parts need only be under your control, it does not matter where they are in reference to each other (garage, car, place of work, bedroom, etc), if you "control" all of them, then there is a felony violation.

Have a friend take the upper off your hands until the lowers are fully registered.

I had the same thing happen a couple years ago. While waiting on paperwork for a SBR, I found a great deal on an upper. Had it shipped to my Dad, who did not have any AR's at the time to keep for me until my paperwork came through.

Well it was frustrating since I was very clear that it wasn't supposed to go to my billing address for these very same reasons.

No funny business was intended. So the plan is that it shows up on Friday, my friend (possibly my father) will swing by, and store it at his house.

An added layer of stress when I should be absolutely thrilled my upper finally shipped. D'oh.
