Are the NIB SBR serial # automatically registered NFA, or are they available to be split from the upper and used as a regular receiver?

this is why I'm asking.  If I have already have a RR with a 16" upper, but want a 11.5 on it...So I buy an SBR that has been "split"  from a vendor and put the 11.5 on the RR & the old 16"er on the new lower= no wait & stick the man for $200.

If you want an 11.5" barrel and a stock, there is no way to "stick the man for $200" if you want to stay out of jail.  If you haven't got a $200 tax stamp, you can't have an 11.5" rifle, period.  Buying a short upper and putting it on your existing lower without ATF approval is begging for jail time.

If the rifle is already SBR'ed by the manufacturer and transfered to you on a Form 4 then it is already in the NFRTR.  You can split the upper and lower, but the lower is still an SBR.

If you have a NFA machine gun lyou can buy an upper of whatever length you want and stick it on it.

I wanted to buy new, factory assembled upper & lowers. (yes a 6933)  Well, I guess this is dependent on a vendor willing to split an upper & lower to make a sale to begin with.

Teh question is, is that lower upon manufacture an SBR.  if they physically separate the 2 halves & send them to me, and I put the shorty on my RR I should be GTG.  but if the lower is already SBR'd that wouldn't work

I doubt you are going to find a dealer who is going to break apart a real Colt LE6933 and sell the upper by itself at anything resembling a reasonable cost.

Yes, a Colt LE6933 lower is already an SBR'ed lower.  The gun would transfer to you on a Form 4 (i.e. already an SBR).  If they physically seperated the upper and lower, the lower is still a SBR and would still have to transfered on a Form 4.  You are good to go regardless of how you obtain the upper since your existing lower is a RR machinegun.  Just don't put the short upper on any other lower that is not a machinegun or SBR.

So, you already have a ar type machine gun, but you only have a 16" upper?

I don't believe that there is any requirement for barrel length on fully automatic guns (at the federal level)

As long as you only own the one m16, I believe you can have any barrel lenths you want.  The only issue is that if you also have non-NFA lower receivers its not a good idea to have extra sub 16" barrels/uppers laying around.

If you want just the upper from a factory colt sbr, you may be SOL as that they are rare and coveted.  If you don't NEED to have a colt upper, there are alot of other good upper end choices like LMT or Saber.

Yeah, I know.  My Sabre has the best fit & finish of any gun I've seen.  but the colt upper would make an all colt MG, come with the correct bolt group ect.  and since the 16" upper is colt also the remaining lower would complete the colt koolaide collection.  oh well

I bought a complete 6933 last year for $1,500 (plus the $200 tax). I have a Colt M16A1 and eight or ten uppers and wanted to add an RO933 to the collection, but couldn't find one under $1,200 for just the upper ... by buying a complete registered 6933 I got the upper I wanted, and the extra $300 gave me a lower on which I could legally use all of my M16 uppers, including the 14.5" M4s, the 7" DOE, the LRM M169, etc.

Even with the $200 tax + $300 net cost of the lower, paying $500 for a complete new Colt lower right now is a bargain. If I wanted to, I could write a letter to BATFE "unregistering" the lower and probably sell it for more than the $500 I have invested. But I find it is really useful to have a second lower to use with all my uppers. And there are times where I don't want to drag a $15k machine gun around, but a $500 SBR is perfect.
