Hey folks,
I currently have one can on a trust.  I'm about to purchase can #2.  The Class 3 folks I'm doing this one with aren't too savvy on the trust thing so let me get this straight, I need to send in my Declaration of Trust, Certificate of Trust, Schedule A, and Form 4.  On the Schedule A, do include BOTH cans/serial numbers or just the new one?  Thanks

First, let me preface this with the 'ole "I'm not a lawyer" speech, so someone else more knowledgeable may come by and give a different answer...

If the suppressor that you already own and have possession of is listed on the Schedule A of your trust, you should be good to go.  I believe that the main reason the ATF wants to see the Schedule A is to verify that there is "something" in there in order to make it a valid trust.  Once your Form 4 is approved for your new suppressor and you take possession of it you should add it to your Schedule A.  While I'm not sure that anything will be said, I wouldn't want to submit a copy of a trust to them without having all NFA items on the Schedule A that have been entered into the NFRTR.

JS_280 is correct. I have a trust and my attorney said that you do not add any items to your schedule A until you have the form 4 and the item in possession. Also you do not send certification of trust, just the declaration because it is actually the trust. I hear that forms are being kicked back because of sending only certification of trust.

do you have to send in the schedule? I did not think you had to but I could very well be wrong!

JS_280 is correct in his above post that they want to see your schedule A to be sure something is in the trust. My SOT said it had to be sent in with the complete trust document to be valid for ATF. I am sending three form 1's in next week so we shall see.

i read that there needs to be something on the sch. A   like adding $10 to the trust... but after that, no need to ever add any NFA items to the sch. A....

The first two trust transfers I went through I did NOT send my Schedule A. They were approved no problem. The third and forth I sent in recently (were mailed within a week of each other) also did not include my Schedule A. One was kicked back requesting Schedule A, the other was not and is approved. It appears to me it depends greatly on the Examiner but from this point on to be safe and to avoid any hassle I will be sending the complete trust with Schedule A.

On my Schedule A I have as the first item $1 cash followed by 2 SBRs and 2 Suppressors. All contain make/model/serial and the date added to the Trust (the date the form was approved after getting the item and looking at the date on the stamp). No problems thus far.

I include everything on mine.  Including the firearm (the trust has purchased) the paperwork is for.  I've not taken possession of the item yet but the trust does own the firearm awaiting approval.
