| I am having a discussion with a co worker about my planned SBR Build and he asked a valid question that I would like the answer to. So far all I have done is send my lower out to be engraved. I have a Form 1 mostly filled out and will be taking it to get the CLEO sig soon. I have a line on a barreled upper. it is just the receiver with the 10.5" barrel, gas block and gas tube installed. Nothing else. Is it legal for me to buy this now or do I need to wait till I get my stamp? It would be a FTF from an individual who took it off a legal SBR and replaced it with a slightly longer barrel. |

I found a good deal from an individual on GB for a new SDI 11.5" barrel when I was waiting for my first Form 1 to be approved. I bought it and got him to hold off on shipping until I got my Form 1 back a few weeks later. I guess bottom line is if you buy it from an individual, nobody would likely know, and what is the chance of someone searching your house and finding it? However, having said that, I still didn't feel comfortable about the constructive possession thing. |
| It would suck to engrave your name, city and state only to discover that a CLEO signature wasn't going to happen. If that happened, you would need to form a trust / LLC / corporation and re-engrave your receiver with the name of the entity you just formed. Hence my recommendation to obtain a CLEO signature before engraving. |

I would (I recently did) have secured the CELO's signature on the Form 1 before sending the lower out to be ingraved. If he/she refuses to sign and you don't want to go the other route(s), your now married to an engraved lower receiver. Then I waited for the Form 1 approval for ATF before buying my 11.5" bbl. When it arrived I was good to go. I will say that I enjoyed every step of the process and found excellent info here on "how to." |
