I recently mailed off the following to BATFE in Atlanta:

Filled out Form 4 in duplicate
Citizenship declaration
$200 check
Original notarized certificate of trust
Schedule A


I did not include the declaration of trust. I don't think BATFE has any business reading about how I plan to manage and distribute my trust assets.  I had previously read that the certificate of trust alone was OK, but now I'm hearing that BATFE wants the full declaration.  Which is correct?

Unless your trust is more than 20 pages, it doesn't seem like a big deal to me.

Right now, they pretty much all want to see the declaration of trust (including the Scheduele A) . However, some Applications are being approveed on certifications of trust, so there is a chance that you won't be asked for more info. ATF wants to ensure that your trust is binding, hence why they are asking for the declaration.

I had a copy of the declaration in my hand. I don't know why I didn't put it in the envelope with it...

Worse case I send it when they ask.

just an update:

Trust transfer without declaration of trust went through A-OK.  In fact, it was processed really fast.

Since it seems to be a bit of a crap-shoot, who was your examiner?

You are verifying citizenship of the individual agent of the trust (or other business entity) when the applicant is not an individual.

dropped mine in the mail 3/26/2008.

2 form 4's
1 5330.2
1 declairation of trust (all 14 pages)
1 copy of notarized certification of trust
1 schedule A (without the suppressor, as it is still technically my dealers property)
1 $200 money order

hopefully I have all my 'papers' in order, and I can shoot suppressed soon

I didn't include my Dec. of Trust and they contacted me to get it before approval.

I just had my form 1 kicked back because I did not include my declaration of trust, I've done other transfers without it but I was told that this is a new change that became effective within the past month or so.  You might get lucky without it, but it seems to be the new rule.
