I've purchased my NFA toys under an LLC for a variety of reasons.

Now I have a question.

Supposing I chose to move from Arizona to another NFA friendly state.  Is there a simple and elegant way to move the LLC and retain ownership of my toys?

Or would I need to set up a new LLC in the new location and then pay a new $200 transfer on each item?

Not really.  You could hire someone in Arizona to act as the statutory agent for your LLC.

That would be an option.  You could use a trust instead of an LLC of course.

Couldn't you just register the LLC with the secretary of state of your new state (as a foreign LLC) and do a 5320.20 for the move to show the address at your new residence?

This assumes your new state is NFA friendly, and you would still have the LLC in the old state, so there may be filing requirements, but there wouldn't be a need to transfer the NFA items from an old LLC to a new one.

You are absolutely right.  I was focused on what it would take to maintain the AZ LLC.  I forgot about the possible requirement to register the AZ LLC in the new state as a foreign LLC.

I live in Gerogia and have my NFA items under a Georgia LLC.  If I move to another NFA friendly state all I have to do is change the LLC's physical address (and notify the ATF of my address change).  As long as I send in my $30 registration every year between January & April it is a current and valid LLC.  They don't care if my address is in another state, it is still a current Georgia LLC.

You should find out if it is the same in your state.  I know Nevada allows people to set up NV LLC's and live in other states.  AZ may be the same.

You will need someone with a Georgia address to act as your registered agent.  Look at item 4 in the form to create an LLC in Georgia:  "Name of LLC’s Registered Agent in Georgia", "Registered Office Street Address of LLC in Georgia".

That is true.   There are several companies that will act as your agent for a small annual fee.

CT Corp is one of the big ones.

The Georgia LLC page you refer to is the initial form for setting up a new LLC.  Every year "after" the first year of registration, I get a renewel card which states you can change your address to another state "without" a local agent.

I just looked at an annual registration form for a random Georgia LLC.

You can put any state you want in the LLC address, but you can only put GA in the registered agent address.
