If I made my check out to the "dept of treasury" instead of the "dept of justice" will it get kicked.  Slightly older forms say dept of treasury, new forms say dept of justice.

You should be okay.  For some reason lately, the bank has been more selective about what they will and wont accept though.  There currently are discussions under way to get a list of what will be looked at as an acceptable payee by the bank.

I made mine out to ATF. Will it get kicked back?

On the current Form1 in section 1 it says, " Submit with your application a check or money order for $200 made payable to the Department of the Treasury".

In the instructions section 2. f. Remittance. It says "make payable to the Bureau of Alcohol, Tobacco, Firearms, and Explosives.

Either should be correct.

I made mine payable to UNITED STATES DEPARTMENT OF THE TREASURY and in the 'notes' section of the check wrote making tax SBS remington 870 serial number XXXXXXXX.

Check cashed, no problem.

I made mine out to the Dept of Justice (per the form 1 instructions) and it got kicked back to me with a note indicating it should be "Dept of Treasury - BATF"
