I have decided to set up a corp and get the ball rolling! I would like to find out the exact provision which allows you to own nfa/title 2 weapons by the corp route. I looked at the ATF website and all I found was references to the CLEO route. Any help directing me to "the horses mouth" so to speak would be greatly appreciated.

Also I would like my sister and hunting buddy of 25yrs to be listed as well on my corp. He would not own a share but I would like him to be on it as well. Would he need to be an officer or could I need to ref him in the minutes??

Thanks for the help

First, make sure NFA is legal in your state.  Second, if your sister and buddy are part of the Corp, they can weild your stuff at their leaisure.

If you decide to go the LLC route, you will need to decide between member management and manager management, before you file Articles of Organization.  You will also need an Operating Agreement.  Expect to pay an attorney $1K to $2K for an operating agreement.

If you were doing a single-member LLC I would say to use LLC Maker instead of an attorney, but your situation sounds a bit too complex for that.  Actually, if you were doing a single-member LLC I would say to use a trust instead of an LLC.

Thanks for the info. The reason I am not going the trust route is it would be desireable for me to have the corporate shield. Where can I find the wording of the law that allows me to do this?

Thanks,

From the instructions for Form 1 or Form 4:

The term “person” means a partnership, company, association, trust, estate, or corporation as well as a natural person.

I'll try to find it in the U.S. Code this evening unless someone beats me to it.
