Can anyone asked you to show proof that you legally own an NFA item and are you required to show it? Thanks. |

Anyone can ask to see proof. But you are under no legal obligation to show it to them. A Form 1 or Form 4 is a tax document, no different from the Form 1040 you file every year with the IRS. No one, including LE, has a legal right to see it without first getting a court order. However... In most states, LE has the legal right to confiscate NFA items until they can establish that they are legally possessed by getting verification from BATF. That often can take days, and in the meantime your expensive toys are bouncing around in a squad-car trunk or stacked in a damp property room. So most NFA owners prefer to carry copies (not the originals!) of their Forms to show LE when requested, which usually results in your being allowed to go on your way and take your toys with you. Similarly, many ranges and MG shoot ROs require you to show your Form 1s/Form 4s to prove your NFA items are legal before letting you use their facilities. You have a legal right to refuse to show them; and they have the legal right to refuse to let you use their facilities if you don't produce paperwork. |
