When my Krink is finally approved...does the ATF send me the docs notify me, or the FFL that it's done?

You usually received your approved form/tax stamp in the mail.  Suppose it depends upon which address you chose to use.

Once your check for $200 clears you are good to go.

ATF won't cash it until it is approved and in the system.

That is not correct as I understand it. Clear or fail, you're out the $200. Also it depends on how you are doing the krink. I bought mine built from a Class III, they sent him the papers. If you are building your own, or having it built, I believe they send them to you. If you are buying from an individual, they send it to them, then you get it when the transfer is done.

nictra is spot on.  Just because they cash the check is not approval.  If you carry that SBR around without the Tax Stamp you will be going to jail, at least in Texas.  And you could still go to jail cause it is a "defense to prosecution", in Texas.  I'm not sure of UT law, but the federal law mandates approval.  When I did mine I had it built.  I filed my Form 1 and checked on it every couple of months.  When I checked and the guy told me the check was cashed he even said, "That does not mean anything is approved."  When I checked back later and he said it had been assigned to an examiner he said, "That does not mean anything is approved."  When dealing with firearms and the feds always play it safe and get the stamp in your hand.

A lot of people start the engraving, etc. once they received notification their checks are cashed.  Luckily, most of them get approved but you'd be a sad camper if you if you tried to start the SBR process on that assumption only to not get it approved.

The ATF will issue a refund if your form is not approved. Remember you're paying tax on a transfer. No transfer, no tax.

They'll send a f4 to the transferor, and a f1 to you.

One caveat though, I'm still waiting on the only refund I have ever had issued. It will be 6 months on the 15th.

Best to get your forms right the first time, and FYI they are not approving forms with "Zombies" for the reason anymore. They do not find it funny.

I would have asked for official documentation to support that claim.



Anyway, if you ever have any serious concerns, just call the ATF. And if it's still not clear, have them issue you a letter stating it in writing and signed by an agent.  It's best to keep your ass covered.

I live in Maryland. Has anyone done any class 3 weapons, short barreled rifles, or suppressors, using a revocable trust? I hear you do not have to get your local state police approval, no passport photos, or fingerprinted. However, I have heard that there are some downsides if done this way... Any info?

That is awesome!

To clarify, I bought a SBR straight from the builder and they transferred it to my FFL. It's sitting there (for about 3 months now) and so I was wondering when/if it's GTG, do they notify me or the FFL? Sounds like it will come to me from responses and I go pick it up from the FFL.

I'm going to call tomorrow just to see how things are coming along.

To the OP, there are three different scenarios in which a person can acquire a krink sbr.  the first two involves making it a sbr yourself, the other is buying one that is registered already.  if a trusts or other business entity is the transferee, its exactly the same except for how the form is filled out.

1) id imagine that most people with krinks went this route.  first you would have bought a parts kit and a receiver.  then you would have filled out a form 1 (application to make and register a firearm).  even though you may have a professional builder assemble the weapon, since you put gathered all the parts, in the eyes of the atf you are the maker, the builder is just doing "gunsmithing".  then the kit could be sent off to builder(one with a sot) to be put together.  they can put it together before its approved, but they cant send it back to you until so.  and since you are the manufacturer, the atf will send the approved form back to you, and then you tell the builder to sent you your new toy.

2)pretty much the same as above, but instead of starting with a kit and receiver, you start out with a assembled gun with a long barrel (like a SLR 107UR).  again you would fill out a form 1, and when it comes back approved, you can chop the barrel, and get it engraved with your sbr info.

3) you purchase an assembled gun that is already registered.  ill just assume the gun is already at your dealer cause im running out of time.  since the gun is already assembled and registered, you arent the manufacturer, you would fill out a form 4(application for tax paid transfer and registration of firearm).  its exactly as it sounds, its just a form that is used when an nfa item is transferred from one entity to another.  once it is approved, the atf will mail the approved form back to the dealer that is doing the transfer.  the dealer will then call you and say you can pick your stuff up.

so who gets the form in the mail depends on which route you took.  the best thing is to try not to think about it, except when you are stocking up on accessories and ammo for it.  dont worry about not being approved, if you have a clean record, and your paperwork is filled out correctly, youll be fine.  and if there is a problem with your paper work, they'll just ask you to send in a new form with the corrections, and since you will have an examiner by then, your wait will pick up where it left off, and not start all over again.

this covers 99% of the cases, there will always be a few oddballs out there like when i got my first silencer, my dealer never got the approved form in the mail, so i had to get a certified copy from the atf, which was mailed directly to me(which doesnt have a stamp), i then took it to the dealer to pick my can up.

hhmmmmm, I don't know about this, but an FFL has to have a store front, so I don't know what would happen if he closed doors with anything pending.

True that.  My Krink has been pending since June 18th with the infamous Sandra Snook.  I mentioned that to a couple guys that have a lotta NFA gear this weekend at a shoot I go to every month.  I mentioned the name and they just started cracking up laughing.  It's my first and I took route # 3 as well.  I actually bought the damn thing at the beginning of January.  Sent in my paperwork about the third or fourth week in April, went pending (had money order so I don't know when check cashed) on June 18th, and have been waiting ever since.  It's almost October and this thing started PENDING at the beginning of the summer.  And it's even worse considering I won the auction just be New Years and paid for the item just a few days after.  Two transfers, $400 in fees, 9 full months now and counting....

I called about a week and a half ago and received notification that an error letter was generated.  I called Ms. Snook (who is actually surprisingly pleasant and helpful, seriously) and she explained the couple things I didn't include with the initial filing.  One I had to mail to her as she needed the original signature (apparently they need TWO signed applications) and I faxed the other items from my Trust.  Called her Wednesday and asked if she had received everything.  She took a quick look on her desk and said she had everything she needed. I asked her what the ETA is and she said, "I'll have this out for you today."  So hopefully my stamp will be showing up next week some time and I can FINALLY pick my first NFA item up.  

In the long run, it was a major pain in the ass but worth it.  The NFA branch is just fine it's only that they have a helluva lotta applications to process and only 10 examiners.  I plan on getting plenty more, none of the least of which is SBR'ing my PS90 and picking up a can some time soon.  It's worth it overall if you can stand the wait.  But you might want to consider buying stuff from a dealer or making your own.  Buying something out of state means 2 transfer fees and having to wait for the process twice.
