First is; Would it work fine without heat treating?

Second; If the holes were a few thousandths off, would it make a big difference?

It will work with a soft receiver, BUT..... the holes will quickly wear egg-shaped, and you may well get distortion of the metal around the holes in the form of bulges or "wrinkles" in the metal as the stress pulls the thin, soft metal.

As for the holes being "a few thousands off", that depends on "off HOW"?  
Holes too big, holes mis-located, holes not square with the receiver?
There's no way to determine what effect holes mis-located will have until you test how the trigger group fits and functions.

If that's the case I would just scrap the receiver and start over.

The only heat treating I have done on my builds is around the FCG axis pin holes & ejector tangs.
I did mine with a cheap MAP torch & a gal. can of old trans fluid.
My first build was on a blank & the FCG holes were visibly off location but the gun still works.
So a few thousandths off may still work, it just depends on which direction it is off.

I've never build an AK before, but the heat treating looks to be the easiest part.  Why not do it just for the piece of mind?

With all that said:
Unhardened holes----BAD.  
The receiver will probably not last long, and in some cases you may see distortion of the receiver around the holes almost immediately.

Misaligned holes in any direction or number of directions----- It may still work, or it may not.  All you can do is see what you get.
