If I buy a preban complete lower can i put my own preban upper on it and be legal?

yea, but there has been talks about the lower has to have been a complete gun before the ban. I dont know of the truth to that tho.

There are actually two kinds of pre-ban lowers - "named" AW's and those defined by features.

If you buy a "named" AW lower, it's an AW no matter what, and you can transfer it stripped, build it up as a pre-ban or post-ban or whatever, and it will never lose its status.  The only "named" AW's are pre-ban Colts marked "AR-15", which includes the AR-15 SP1, AR-15A2 Sporter II, and 134 of the AR-15A3 Tactical Carbines.

If you buy a feature-defined preban, which includes all Colts made after 1989 (except those 134 A3 Tactical Carbines), and all "pre-bans" from any other manufacturer, ATF has stated that the rifle must be transferred only as a complete pre-ban configured rifle or complete pre-ban kit in order to retain its grandfathered status.

The "loss of preban status" issue has not been taken to court yet, but it is ATF's stated position, as of early 2001.
