I was discussing a few days ago with a group of shooters at the range, they said piercing ammo is available and I said no, that it was not available to the general public and they even said you can get it at Academy Sports, I said they were full of crap, can someone please chime in so I can print this posting and put in my range bag to show them....

They're probably under the mistaken impression that M855 is armor-piercing ammo, which it's not.  ATF has specifically stated it's not AP.

Do you mean Armor Piercing ammo (as classified by the ATF) or ammo that will pierce armor. They are two frequently confused subjects. So, to answer your question, AP ammo (as per ATF) is not commonly available but ammo that WILL pierce armor can be found everywhere!!!!

AP ammo is legal to own, sell, reload and shoot, at least as far as the federal gov is concerned. There are a lot of states that forbid it.


That said there are separate charges if it is used or possessed in the commission of a crime.





USC 18, part 1, chap. 44, ss929 is the relevant code.















(a)





(1)
Whoever, during and in relation to the commission
of a crime of violence or drug trafficking crime (including a crime of
violence or drug trafficking crime which provides for an enhanced
punishment if committed by the use of a deadly or dangerous weapon or
device) for which he may be prosecuted in a court of the United States,
uses or carries a firearm and is in possession of armor piercing
ammunition capable of being fired in that firearm, shall, in addition
to the punishment provided for the commission of such crime of violence
or drug trafficking crime be sentenced to a term of imprisonment for
not less than five years.






(2)
For purposes of this subsection, the term "drug
trafficking crime” means any felony punishable under the Controlled
Substances Act (21 U.S.C. 801 et seq.), the Controlled Substances Import and Export Act (21 U.S.C. 951 et seq.), or chapter
705 of title
46.








(b)
Notwithstanding any other provision of law, the
court shall not suspend the sentence of any person convicted of a
violation of this section, nor place the person on probation, nor shall
the terms of imprisonment run concurrently with any other terms of
imprisonment, including that imposed for the crime in which the armor
piercing ammunition was used or possessed.

What about .30'06 Black Tip ammo, isn't that AP?

That stuff is (or was) commonly found for sale, at least a few years ago.

the '06 AP is specifically exempted by ATF.
