I'm sure some of you are aware of this. I wish I were surprised.

Government prosecutors love two things: 1) vague statutes so they can decide what's a crime and 2) potentially draconian penalties for everything so they can strong arm a plea deal whether someone is guilty or not. If Mr. Taranto wants to go the distance on this now may be the time. Maybe this gets pushed through the court system with a favorable outcome for us all and with a friendly administration in place to issue a pardon as a last resort.

I'm pretty sure DOJ has a major woody for Mr. Taranto given the backstory on his legal troubles. Probably has his own satellite just waiting for him to make a mistake, any mistake they can hang on him

Of course, for most of us the ATF couldn't care less on the brace/stock SBR issue but if they really want to go after someone it's available.

most of the cases I have seen were gang/drug affiliated with numerous other federal charges to go with weapons charges. Im already cooked sitting on about 40 stamps but i like to tease for sure. We didnt have braces in early 2000s, I remember people writing letters to ask permission to stick a rubber stopper or tennis ball on the end of the smooth pistol buffer tube to "prevent firearm from falling unsafely" . If you wanted a factory SBR, it was super easy though and paper forms were fast then.

So I've been searching here, google, etc. for an answer to this, which might not even exist outside the malevolent overlords at the ATF, so I'll just ask:

What does the ATF consider to be the defining difference between a stock and a brace? I have love Vltor Emods since I had one on my patrol rifle somewhere between 15 and 10,000 years ago, largely because of the ergonomics of the comb, a lower 1/3 Aimpoint, and my skull, so I scribbled something with a vaguely similar silhouette in Fusion, and printed it in PLA+, because I'm just a mere mortal with an old Ender 3. It has a very painful QD sling swivel sticking straight back, roughly in line with the buffer tube, a velcro strap that fits around my arm, and a single pinch bolt that clamps it down around the (1.25") buffer tube, but it feels too good to be legal. How much danger have I put my cats (I'm not a dog person) in by making this? The "blade" of the brace is .250" thick, and it's currently about 1.5" longer than the buffer tube to make room for the sling swivel socket (.600" long socket + .500" for it to attach to + another quarter inch or so for the nut and to clear the end of the buffer tube = 1/5"-ish). Also, no, I'm not posting pics, because that would be violating my 5th Amendment rights. It's intended for my cheap and easy (like me) 10.5" 5.56 DI AR, which is, unfortunately, not quite 26" long (also like me), which has ruined my plans to build a non-NFA firearm, so a pistol it is.

Other questions I've been pondering:
1- Does the ATF have more of a boner for 3d printed parts than an injection molded copy of the same part?
2- Is there some magical length of pull that makes them leap onto the kitchen table while screaming, "eek, a rifle!!!" ?
3- Will the next season of South Park be out before I die of old age?
4- Will Primary Arms still honor the warranty on their ancient Aimpoint clones?
5- What was I talking about before going off on this tangent?

Yes, my doctor has me on some pretty good stuff, because I lost at a one man game of cops and robbers.

Looks like they dropped the charges.

Part of me hoped it would end up going to SCOTUS at some point.

I don't really believe the DOJ/ATF was being magnanimous, I think they realized it would be a lot of time and money expended on a losing cause and very unfavorable decision(s) against their interests.

Nothing will happen. They'll never get approved. So yeah, DOA.

If those applicants want, they can file Form 1 again after January 1, 2026 for free, just like everyone else can.

Which is probably what I will do. Maybe. The brace does allow for some flexibility of travel.

Information to Pending NFA Forbearance Applicants Submitted Pursuant to Final Rule 2021R-08F
On January 13, 2023, the Attorney General signed ATF Final Rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.’” Those possessing firearms with a stabilizing brace that were classified as short-barreled rifles under the Final Rule had until May 31, 2023, to file an ATF Form 1 application to register the firearm in the National Firearms Registry and Transfer Record (NFRTR), or to take other action. The NFA Division processed most of the ATF Form 1 applications it received but stopped when required to do so pursuant to Federal court orders. Ultimately, due to challenges under the Administrative Procedure Act, Final Rule 2021R-08F was set aside nationwide and has not been enforced.

Even though it was set aside, individuals who filed an ATF Form 1 application pursuant to Final Rule 2021R-08F may desire that the NFA Division process their application and effect registration in the NFRTR. This may be the case for numerous reasons, including that firearms with stabilizing braces are regulated under State law and registration in the NFRTR provides an affirmative defense to unlawful possession of that firearm. Other individuals may have installed a regular shoulder stock, anticipating that their firearms would be registered. Consequently, ATF will begin processing the remaining applications beginning Wednesday November 12, 2025, unless those who submitted the ATF Form 1 applications provide notice to ATF that they do not want their applications processed.

For those who want their firearms to be registered: No further action is required by you. ATF will process your pending application.

Never seen this yet..So they are going to start processing the old applications again..That seems very strange they would start processing these old applications again as of this date.
