If I purchase a new never built lower from an individual that I can only assume was purchased as a rifle can I use that lower as a pistol? If not, can it be re-transferred to a pistol? I'll ask the seller how the lower was purchased to be certain.

I'm in Alabama if that makes a difference.

The seller got the lower on a trade so he's got no idea of the status. He, like me, would assume it was purchased as a long gun.

A new never built lower can't  be purchased as a rifle unless someone made a mistake or it's prior to the revised 4473.  May be logged as a rifle at the maker but if the maker didn't build rifles then it's still just a receiver.  May be logged as a rifle on an old 4473 but if it was sold as a receiver, it's still a receiver and not a rifle.
