OK, all. I'm prety sure I'm right but I just want to run it by the experts. I don't have a lot of disposable income for toys so here's my current plan. I want to buy a stripped lower in preparation for the expiration of the AWB. I already have a collapsable carbine stock and a spare pistol grip laying around so, if I just bought the lower and put the parts on it in Sept, it would count as an AW if the ban is then later renewed before I can complete the rest of the weapon, right? Seems right, the lower is the weapon per the ATFE and it would already have the "Evil" features (PG, collapsable stock and ability to accept hi-cap mags) before the ban was renewed. Like I said, seems right but I'd like verification. I REALLY want an ultra-light carbine, collapsable stock, BM Ultra-Light 16" barrel, etc. but don't have the $$$ to do it all at one time and I'm worried that the ban might be re-imposed before I can get the weapon completed. Technically, possessing a colapsible stock, a pistol grip, and a post-ban reciever is already breaking the law....you can only have 2 of the indicated "evil" items (which includes a detachable magazine) and that would make 3...doesnt matter if its assembled or not. Granted, probably no one is going to beat down your door and toss every room looking for gun parts, but it is against the letter of the law...and if you dont posses any uppers, then it might not matter anyway, but im not a constitutional lawyer, so I cant garuantee either way. As far as after the ban, put it all together and enjoy. Even if the left comes up with some new great idea to steal our liberty again, your creation should be grandfathered just like the current "pre-ban" stuff is today...I hope |

I'm gonna try and say this as diplomatically as I can. Don't believe some of the things that are posted here about what you can and cannot posess in relation to the AWB! You can have as many FH's, FSB's w/bayonnet lugs, collapsable stocks, etc. along with all of the post-ban lowers as you can buy all under the same roof. The trick is that you can't have them assembled into a weapon at this point in time. There is no such thing as intent spelled out in the AWB. Gather all of the parts together and wait for Sept. 14th. Keyboard lawyers often confuse the AWB with the NFA. If and when the AWB sunsets it will be as if it never even existed in the first place. Anything enacted later will be a whole new ballgame! I'm sure that there is a tacked thread around here that contains the correct facts. Find it and learn! |
| Under the current AWB, to be grandfathered it must have been a COMPLETE rifle. A complete lower with grip and telestock is NOT a complete lower. Under the current laws, it would not be grandfathered even though it has enough evil features. Put down the extra cash and get the upper also. |
I believe that the ATF has stated that a lower with a collapsible buttstock, but no upper, is still consideered an AW. They have also said that a preban rifle has to have been complete and asse,bled (even though earlier they said it only needed to have all the parts together in one place) . There have ben a lot of contradictory information about what consititues a preban and what constitues an AW. There has also ben constant interpretation and reinterpretation. I think the ATF will actually be glad if/when the ban expires as it will save them the headaches of figuring out exactly what the AWB means and all the constant questions about the damn law. |

TNFrank, I've seen those in shotgun News but really wanted a Bushy Super-Light barrel with 5.56 chamber and chrome barrel and chamber. That's why I asked about the assembled lower. The Bushy barrel, last I checked, was slightly over $200.00. I'll be lucky to come up with the $100.00-$150.00 for a forged lower by September! This is the only bad thing about being married with children. I had money for toys before I got married! Now I have to actually buy things like clothes and food! Bub |
