I'm currently filling in the blanks of the SilencerShop trust for my first NFA purchase in Texas.
I intend to list my son as a trustee, but he doesn't turn 18 for a few months. So the question is, do I add him now -- knowing that he will be 18 by the time my first stamp arrives? Or wait? Thanks! |

Does your son intend to be in possession of the item without you being present? If the individual reviewing your trust speculates that they may indeed do so, it could impact your approval.
Personally, I would never name someone whom is under twenty one, much less under the age of majority, as a trustee. By naming him a trustee, he will essentially be able to have unsupervised access to items that he would otherwise be unable to acquire. I'm not saying it would not be approved. I am just stating that you will have one hell of a court case on your hands if he was using the device unsupervised. I am in no way shape or form accusing you of intentionally skirting the law. Nor am I attempting to undermine your intelligence. I just prefer my fellow enthusiast to think of the possibilities. |

You can own a silencer at 18 but you can't purchase one from a dealer until you are 21. FIFY. You could buy one from an individual, or make on via a Form 1, at age 18. Or, as mentioned, a trustee 21+ could buy one on behalf of the trust and the 18-20 year old trustee could be in possession of it. |
