This may be in the wrong forum, please move if so...

I sold a lower last week.  I am in TX and the buyer is in PA.  I sent it to his FFL and now his FFL is saying that it has to come from a TX FFL to him due to ATF laws.  I have always shipped straight to FFL's before.  Is this something new or ???  His FFL told him that if it crosses more than 2 state line than it has to go from one FFL to another

Pretty much. Alot of FFL's won't take transfers from private parties, due to their insurance. But there is no law against it. I think they are just loosing some of the business they could be having from it, but to each their own. I'll spend my money elsewhere.

How hard is it to get an FFL?  I mean jesus, a lot of the FFLs I've worked with are really great people, but some of them are about a bright as a rock.  Guess it's just about like any other profession in life.

Seriously though, what is required?  A storefront, the application and the fee?

I've only came across this with pistols, but a long gun nope. Make sure that whoever you sell to that their ffl will accept from a non ffl shipper. That's all.

If it crosses five state lines you have to include both thumbprints.

I just went through this with  a sale of a lower to an arfcommer in Illinois. His FFL sent me a copy of his license and then decided after I mailed the receiver that he wasn't going to accept it from a private party and was going to send the lower back. He finally relented after my buyer had his lawyer contact him. Was a PITA for all involved!

No, this is a problem I occasionally run into with idiot FFL dealers who don't know the law. Any individual can ship to an FFL in another state, regardless of the sender's status, that hasn't changed.

(B1) To whom may an unlicensed person transfer firearms under the GCA? [Back]

A person may sell a firearm to an unlicensed resident of his State, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may loan or rent a firearm to a resident of any State for temporary use for lawful sporting purposes, if he does not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under Federal law. A person may sell or transfer a firearm to a licensee in any State. However, a firearm other than a curio or relic may not be transferred interstate to a licensed collector.
[18 U.S.C. 922(a)(3) and (5), 922(d), 27 CFR 478.29 and 478.30]

It simply means that holders of  a curio and relic collector's license can only receive interstate transfers of curio and relic firearms, not modern firearms.

An unlicensed person should always contact the receiving FFL and inquire if he/she accepts firearms shipped from unlicensed persons and what they require in the form of identification. Some FFLs who receive firearms from unlicensed persons will not complete the transfer and in addition will only ship the firearm back to another FFL.
