Me and some of the guys at Black-Rifles were discussing whether firearms rights are restored after a restraining order has expired, are they?

Should be - read the question.  I think it says "Are you . . .  . under a restraining order."

Could be wrong - just a guess.

Restraining orders are for a period of time. If until the next court date if temporary or for a period of 1-3 years. After the restaining order expires your rights are restored unless the petioner files again. Firearm rights are only for CLEATS type orders, a judge can issue a non-CLEATS/no contact order and your firearm rights are not taken from you.

Consult your state laws.  In NJ, a Final Restraining Order is good forever, or until the plaintiff drops it in court.  Even then, the defendant is restricted from owning firearms for two years after.

What is a CLEATS?



Basicly a CLEATS is a criminal based order.  Violate it and your arrested and held until a court hearing. With a non-CLEATS the plantiff must bring a show of comtempt against the defendent.

In MA, the question asked is "Have you EVER been issued a Restraining Order?"

In MA, if you have had one issued EVER in your life, the chief has the right to deny you as an "unsuitable person". In many cities/towns, they use that to deny you for life and it won't matter if the RO was dropped or not.
