It seems to me that so long as I were never to fire the weapon within the state- say I went to Virginia to a range, I would not have to register it because it is not technically in the state. This way I'm always transporting through the state and am protected by federal law...



Tag for a double check on what I think I know.  I would hate to get a billet in the PRK and find my weapons can't go with me.

California is the most friendly of the 'Ban' states towards troops...

Active duty stationed in CA, with a home-of-record in another state, can get an 'Assault Weapons Permit' which allows them to bring their weapons in-state, so long as they take them back out of CA when they are re-assigned or ETS....

Ever try getting one of those permits???? I did and was told that I didn't file far enough in advance, though no one could tell me how far in advance I needed to file.

Aren't military bases considered outside the jurisdiction of the states, so under the Firearm Owners Protection Act (FOPA), shouldn't it be legal to transport from the base, through the state of California (or New York, or Maryland, etc) to an adjoining free state for use, all without a permit?


In theory yes, though you would never be allowed to shoot it off post.

So was I.  

In theory you could bring your privately owned weapons to your new post/base, but there are two problems with this:

1) You would not be able to use them off post.

and, even greater,

2) There is a good chance that the good General in charge of your new duty station has adopted the stance that the post will apply all state and local laws.  For example, at Marine Corps Base Quantico your vehicle must meet all Virginia DMV regulations, even if tagged in another state, or it will be towed/impounded.  These kinds of attitudes often can stretch to other things, and I would imagine they might to firearms as well.

I had one.  No problems.  I applied in advance from Germany and had my permit before I arrived in CA.

That is correct, sir!!  The only place I can think that I might ever be stationed where I would run into trouble is West Point, since NY has no exemption for Active Duty military with non-"preban" AW's.

To the OP, it's just a procedure and $75.  Do it.  It's not too hard, no matter what anyone else says.

Bases in NY want you to comply with NY law, but the reality is if the firearm never leaves federal property, or is used under the target exemption they you can bring anything but class III into Ft. Drum or West Point.
