| I have a standard Benelli M1 Tactical but would like to register it as a Short Barreled Shotgun and put a factory 14" barrel on it. I would like to be able to train out of state with it so here is my question...Can I put my non-NFA 18.5" barrel BACK on it (once registered and marked as SBS) to travel out of state and avoid all the paperwork hassle and headache, or is this a "once NFA always NFA" deal? |
No, the term is "once a machnegun, always a machinegun". An SBR/SBS/AOL can be removed from the NFA registry by sending in a letter to the BATF stating that it has been returned to non-FA status. Actually, it is not removed from the registry, just maked as no longer being NFA. I did this with an SBR - it took about a year for them to return a letter stating that it was not longer NFA in their eyes. This does not help in your case, since you want to keep the NFA status, just lose it when you go out of state. |
| drfcolt, Yes you are correct about "unlisting a NFA gun". But what OPDoc wants to do is change the configuration of the shotgun to cross state lines without notifying the ATF. Which technically he cannot do. However, if the shotgun was not in NFA config, then he would most likely not be questioned as to the NFA status of the weapon. I was merely giving a quick answer that, although not 100% correct for all situations, answered OPDoc's question 100% correct. |
