Is there any federal law that prohibits minors from having porn, that will actually punish minors if they are caught? I have always thought it is a state by state thing. |
not necessarily. they just need to prove that possessing the item would someone have an impact on interstate commerce. see Gonzalez v. Raich. |
because then it falls under federal jurisdiction, as well as the jurisdiction of whatever state you took it into. that is not to say, however, that there is any federal law regulating the interstate transfer of pron. there may well be, but i don't know the answer to that question. |
