I live in the D town too.
I've had drug dealers now for 3 generations across the street.
When  you look at the number of times I've called in 25 years it's
near 4 digits.
It's dayton man, they won't do anything.  Arm up and ruin this guys day
if he comes at you with a firearm in his hand again and you're in fear
for yourself.

Shouldn't I seek the paperwork on the TRO Monday morning?

Im at a complete loss as to which attorney.


This neighbor (no idea the guys name, don't want to know just yet) told the police last night that he fears for his safety because "that guy is a gunowner, and we have seen him with a pistol".

Im trying feverishly to avoid what Im seeing as potential problems for me, beyond the life threats.



He brandished a pistol at you. Call a local lawyer, if nothing else, ask him to recommend one who practices in the area
Your cops suck you need to find  a way to record the area.

Unfortunately, there are no laws or lawyers that will be able to "protect" you. With that said, every threat he makes towards you and every time you have to call the cops on him, these get recorded and will greatly help your legal battle should you ever have to "protect" your own life from any future threat that he actually attempts to follow through on.

Another option is to directly contact the local city attorney or district attorney to see if they'll let you file charges bypassing the police.

Sounds like you need to install a couple cameras.

Otherwise, you ARE just a crazy gun owner and no different than your crazy gun owning neighbor.

I would install a couple cameras at your front door and back. Insure they cover HIS front door as well. Given the relative lack of help coming from the cops, you also need to insure you have a good solid door and lock/door blocking system BEFORE you start something with the cops and TRO.

As I tell friends... It doesn't matter if you have the right away... if the truck runs you down in the middle of the crosswalk.

Take precautions FIRST to secure your OWN safety. Then worry about the TRO. What are they going to do... say he has to sleep on the other side of the bed and schedule coming and goings to be staggered with your own???

Like others have said:

1) you need video and audio proof of what's going on.

2) you better be prepared to defend yourself, with lethal force if necessary, or get the fuck out yesterday.  Not sure if you have a CWL or not, but the only place a gun will do you any good is on your person if you need it.

3) I'd consult an attorney and make sure you know the law with respect to self defense, restraining orders, etc.  Perhaps then, you could go to DA and demand action, with the video and audio evidence you've collected.

4) If I was renting, I probably just get the fuck out and move to a better place.  If I owned the place, it would depend a lot of factors.  You have a right to live there in peace and not be harassed by some asshole.  Many years ago I might stand my ground and solve the problem quick fast and in a hurry; in today's political climate you could end up being "the bad guy" and go to prison which wouldn't be worth it for the sake of this asshole.

In the end, try and use the legal system to solve the problem, if that doesn't work, then you have to decide if living there is possibly worth your life or you having to take another's life.

Here in Ohio, your probably not going to be able to get a TPO against him. In my area at least, unless you have lived with the guy, or have had some type of relationship with a person, it is very hard to get a TPO.



Did you tell the officers that you felt threatened? In the very least, they should have filed agg. menacing or menacing charges against him. If they refused, then you should call their supervisor. If they supervisor doesn't get it done, file a complaint with their department.



Start recording everything. Use your cell phone, or get a video and/or a digital recorder and record everything the retard does. Also, start calling your landlord. Every time your neighbor does something, call your landlord and demand that he do something. If he refuses to help, you can place your rent money in escrow, and refuse to pay him until he fixes the problem.



If your neighbor is causing that much problem, I, too, would recommend finding somewhere else to live. Even if you get a TPO, file charges, etc, none of that is going to do anything to protect you from your neighbor.



Also, start CCW'ing.

Yes I rent this property, and yes the owners/Landlord has been made aware of the situation. Tomorrow morning I will drop off copies of the report(s) and start this process in more sincerety.



I had my CCW in KY, but since moving here have not re-applied to get the Ohio lisc.



I keep a G30 close at hand, and the neighbor told the police last night that they "Have seen me multiple times with a gun, almost like he has one with him at all times". Most, but not 100% of the time the pistol is transferred to a locked container in the vehicle, and travels to the car either in plain sight or in a coat pocket. Never has my firearm been "brandished" or even remotely referenced.



I am now actively seeking somewhere else to live, but due to a heavy tax burden this year, Im not in a great position to be spending a large amount on relocation.



I am not seeking the TRO as a final point of protection, but rather a legal barrier and legal step showing my unwillingness to "be the aggressor"




As long as your KY ccw is still valid, it should be good here in Ohio. Might also be an idea to talk to your Landlord, and see if he has property elsewhere that he could let you move into, and maybe it wouldn't cost much to relocate.

I don't know about Ohio, but here in North Carolina you can go to the local magistrate and file charges. The magistrate will issue a warrant for the guys arrest. From that point the police,  may or may not be aggressive about taking him into custody.

I don't know if there is a statute in Ohio covering this, but in NC "communicating a threat" is a crime and there is no need for corroboration.

If you have a phone with audio/video, keep it on you at all times and make sure you know how to pull up the program that records audio/video.

Keep your weapon on you or near you, but don't EVER brandish it unless it is to protect you. I'm not saying this because I think you're stupid and don't know that already. I'm saying this because I know for a fact that when people fear for their lives, they do silly things. Keep your head about you. Don't let this guy control your life. Don't let your guard down, but don't let this consume you.

When he starts hammering on the wall at 10pm, record that as well. Note the date and time on the video recording "It's March twenty-seventh at 10:37pm. This wall is shared by my neighbor with whom I have a TPO against." etc. and explain what is going on.

Basically, just document everything that happens with this fuckhead from here on out. The slightest thing he does, record it. If you can see him leaving the house from the window, record it. Who knows, maybe he'll turn around and give your residence a nasty look. This alone could cause a judge or jury to put themselves in your shoes and feel that you're concerns are justified.

As far as finding a new apartment, you need to make a choice.

a) Spend the cash and live somewhere that doesn't have you on your toes constantly.
b) Deal with it for the time being and be somewhat nervous all the time.

Just use your head and you should be fine.

Note: Find out if your current landlord has other properties away from your current residence by a good distance (if they were decent landlords of course, if not fuck em).

If OP has a TRO against another of the LLDs tenants, he should be able to break the lease without a financial penalty if he has spoken to the LLD about the other resident and the LLD has done nothing. A TRO should be able to show that the OP has had to take steps to protect himself legally and does not think [and a Judge agrees] it is safe to remain in the apartment he pays on.

May be something to speak to a lawyer about.
