I've got a deal with another member on the EE to get his 14.5in upper. He's including an extended flash hider so I can have it pinned. My ar lower isn't a registered sbr yet. But the upper doesn't come with a bcg, so it can't function. Also, I have no other bcg's anywhere in the house. So there's no chance this upper can function. My question is this: Can I keep them both in my house? If I can't, then I'll just have to leave the upper at my brother's house until I can have it pinned.

Non lawyer common sense answer: Yes, just don't assemble it.

No, it's not constructive intent.  It is constructive possession, but the actual charge will simply be possession.
