So, let's say that BHO is elected and serves out a second term. Then for the next election he is on the ticket as VP to whomever, and is elected. If the President dies with VP Obama, does VP Obama move up to 3rd term President Obama?


(This has nothing to do with Obama, just a question I was asked by a friend and I don't have an answer for him.)

"No person shall be elected to the office of the President more than
twice, and no person who has held the office of President, or acted as
President, for more than two years of a term to which some other person
was elected President shall be elected to the office of the President
more than once."





If Obama were elected as Vice-President and something happened to the President he would become President again.

22nd Amendment says:

Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this article shall not apply to any person holding the office of President when this article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this article becomes operative from holding the office of President or acting as President during the remainder of such term.

Section 2. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission to the States by the Congress.

So that would say that a President with 2 terms under his belt could not run for VP?

But would having served two terms already make him "ineligible to the office of President" or just "ineligible to be elected to the office of President" but eligible to become president through succession, it is all in the wording and such a situation would probably go all the way to the Supreme Court.



Another extremely unlikely scenario: Obama serves two terms then is elected to the House and elected as speaker of the house, the new Pres and VP then die in a freak accident - does Obama become President again then?

A president with two terms can run for VP. He however is skipped over if the president dies and the next in the line of succession is sworn in.

He is going to be just like all other Senators who were elected President, a one-term flop.
