Lets say a guy finds an old Maxim machine gun in his mother-in-laws basement. The chamber has a weld filling it so it cant be loaded and there is no parts left in the receiver, would it still be a federal offense to have it in ones possesion? Very high coolness factor regardless.

I think that a right side plate from an original Maxim is considered the Machine Gun, just as the lower on an AR is considered the gun.

Um, I don't think it's too hard to remove a barrel from a maxim, is it?

Somehow, I think the ATF would consider it in easy-to-restore condition.

Hypothetically, you should take it apart and bury it (in a park or someone else's property) and never speak of it again.

eta: +1 on the sideplate.  When I ordered my RSP for my 1919 build, I had to order it as an "80%" receiver and finish it myself.  Which basically amounted to drilling and chamfering some holes.

So I suppose you could take it apart, modify the internals for semi operation, and rebuild it with a new RSP.  I'm not sure what's involved with that for a maxim, but I'm sure people have done it.

Sounds like a DeWAT (deactivated war trophy)  look for paperwork they were transferred tax free and if I recall correctly can be reactivated.

Edited to correct dewalt to DeWAT

Hypothetically speaking, if his mother in law has a Maxim in her basement, I'll bet "that hypothetical guy" was pretty nervous the first time he asked her daughter out for a date.
