I have stopped using the 2nd as a pro-gun-rights argument point.



For one thing, it is the same old argument the opposition has heard again, and again, and again. They ignore it... It is like a broken record to them. They have tuned out the phrase "second amendment".



In addition to this, they pick through it and come to silly conclusions like "militia" means the national guard, and it is a States' right. It is just too confusing for them, since it contains our kind of words, and they don't understand the meaning. (It is like when I asked my grandma if she knew where my new magazine was... She thought I was talking about a publication.)



In addition, it is too broad of an argument... It effects everything, at all levels.
So...... I now use the 10th Amendment. For those that don't know... It basically says that whatever duties/privileges/rights are not allotted to the Federal Government by the Constitution, go to the People and the States.



Since the Constitution does not give the Feds authority to regulate arms... it would then be a State, or People issue. Our main problem this time is with the Feds, right?



It mixes up the argument... They have to think about what you said, instead of discarding it as "standard pro-gun babble". It is really a pretty simple Amendment... there are not very many ways it could be twisted around. In addition, it makes you sound "moderate"... You just one big government out of it, but the States still remain for regulation (You can use the second to take care of states and localities.)
What do you guys think? I am seeing rather good results with this method.

Yeah, I don't think so.

IL, NY, CA, MA, etc.. etc..

Not a good idea.

Use the 10th temporarily.... because it seems to be more effective against Federal regulation, in my experience.



For your State, you will need the 2nd... But if we can keep the Feds out, we have a better chance.

Don't stop using it.

Just ask the people you're talking with if the founders were schizophrenic enough to use the same term "THE PEOPLE" in three different amendments to the BOR (The 1st, 2nd and 4th) to mean...."Just your average folk" in TWO of them...(The 1st and the 4th) but...in the 2nd....they "meant" () some sort of government organized military force?

Don't stop using the 2nd A.  Even some famous liberal legal scholars (Lawrence Tribe for one) have come to recognize (reluctantly) that the 2nd
A is about individual rights like the First A.  A much better tactic is to tie in the 2nd with the 1st A as examples of individual rights being protected.
