A friend of mine got his gun stolen in late 2006 and just got it back from the Sheriff's Office.  He didn't notice until he got home, but the thief had tried (quite lamely) to scrape the serial number off the butt of the gun (S&W revolver).  Anyway, the SN is readable, but it is obvious what they tried to do.  So my question is this - could he get in trouble even though the SN is readable?

I wouldcertianly want it stated on the police report. Its just as against the law to try as it is to do it.

Could he potentially get in trouble? Yes.

The odds of that happening? Slim since it can be demonstrated that the weapon was stolen from him.

I'd still suggest contacting the nearest BATFE office and asking them about the situation.

S&W might also be good to contact, to see if they can fix the damage and get the serial numbers looking right again.

I wouldn't worry too much, the police were able to see enough of it to know it was your gun.  But, like the other posters said, maybe a police statement for your records might be a good thing.

I do believe you can send firearms back to the manufacturer for re serializing if need be
